A szubszidiaritás értelmezései és alkalmazásának lehetőségei az Európai Unióban

Absztrakt
A szubszidiaritás azt jelenti, hogy egy magasabb szintű társadalmi entitás nem jogosult eldönteni és kezelni azt, amit alacsonyabb szinteken hatékonyabban meg lehet tenni. A szubszidiaritás az egyének és kisebb társadalmi egységek, közösségek szabadsága védelmének záloga, hiszen megakadályozza, hogy a döntések mindig magasabb szinteken szülessenek, így érvényesülése hozzájárulhat ahhoz, hogy egyensúlyban tartsa a társadalom működését. Bár a fogalom tartalmilag, és diszciplinárisan sokkal tágabb értelemben is használatos, e tanulmány az európai, ezen belül is az európai uniós értelmezéshez nyújt keretet. A fogalom európai uniós születése a maastrichti szerződéshez köthető, és azóta tulajdonképpen az eurokrata szakzsargonban változó intenzitással, de állandóan szerepel. A téma aktualitását az említett uniós szerződés hatálybalépésének 30 éves évfordulóján túl, az Európai Unió jövőjéről szóló politikai, jogi és társadalmi diskurzus adja. Az EU jövőjéről szóló vitákban, és javaslatokban ugyanis felerősödtek a szubszidiaritás köré épített javaslatok. A tanulmány a fogalom konceptualizációja után integrációelméleti magyarázatokkal szolgál. Végül az EU jövőjéről szóló vitákban értelmezi a szubszidiaritás fogalmát és alkalmazásának lehetőségeit.
