On the level of an everyday dialogue the paramount value of the child as a legal entity seems to be fundamental and free of ideologies. However, looking the issue in depth it becomes clear that very often this value is determined not from the perspective of children but from the point of view of adults, which causes the rights of children both on micro (family, school) and on macro (national and international legislator) level to be relativised. In order to effectively protect children and their childhood it is essential to deeply understand them and to wear “child rights glasses”. In this study, I try to get closer to this understanding by reviewing from the beginning of history how the man of the past thought about the child, the child’s place in society, the parent–child relationship and how this led to the uncertainties of the 21st century.

A gyermek mint jogalany kiemelt értékessége a hétköznapi párbeszédek szintjén alapvetésnek és világnézetektől függetlennek tűnik. A kérdés mélyére tekintve ugyanakkor egyértelművé válik, hogy nagyon gyakran a kiemelt értékességet nem a gyermekek, hanem a bűvös 18. életévet átlépett felnőttek perspektívájából határozzuk meg, és a gyermekek jogai mind mikro- (család, iskola), mind makro- (nemzeti és nemzetközi jogalkotó) szinten relativizálódnak. Ahhoz, hogy a gyermek és a gyermekkora hatékony védelmet kapjon, szükségszerű a gyermek megértése és „gyermekjogi szemüvegen” keresztül való szemlélése. Ehhez a megértéshez igyekszem közelebb kerülni a tanulmányban azzal, hogy a történelem kezdetétől áttekintem, miként gondolkodott a múlt embere gyermekéről, a gyermek helyéről a társadalomban, a szülő és a gyermek kapcsolatáról, és ez miként vezetett el a 21. század bizonytalanságaihoz.

In my opinion, the legislator did not take into account that if the situation of overcrowding in penitentiary institutions does indeed disappear completely, the following issues will have to be faced: applicants will not be allowed to lodge a monetary compensation claim or other action for damages caused by other conditions of their accommodation, and the right to apply to the court will be excluded. Therefore, detainees will be in an awkward situation since no effective legal remedy is granted neither in compensation proceedings under the Hungarian Prison Act nor in a lawsuit concerning the violation of certain rights relating to personality under the Hungarian Code of Civil Procedure or the Civil Code. It is rather doubtful, whether this could ‘pass the test’ before the ECHR, since the quasi non-recognition of the possibility of accountability is inconceivable under the rule of law.

Véleményem szerint a jogalkotó nem gondolt bele abba, hogy ha valóban előáll az a helyzet, hogy teljesen megszűnnek a büntetés végrehajtási (bv.) intézetek túlzsúfoltsági körülményei, akkor a következőkkel kell szembesülni: a kérelmezők az egyéb elhelyezési körülményeik miatti sérelmek okozta személyiségi jogaik megsértése miatt igényeik pénzbeli kompenzálására irányuló érvényesítésétől teljesen el lesznek zárva, a bírósághoz fordulás joga kizáródik. „Faramuci” helyzetbe kerülnek tehát a fogvatartottak, mert sem a Bv. tv. szerinti kártalanítási eljárásban, sem pedig a Pp.-n, illetve Ptk.-n alapuló személyiségi jogok megsértése iránt indított perben érdemi jogorvoslatra nem biztos, hogy számíthatnak. Ez pedig korántsem biztos, hogy „kiállna egy EJEB előtti próbát”, hiszen jogállami keretek között elképzelhetetlen a számonkérhetőség lehetőségének kvázi el nem ismerése.

This article analyses human development as a human right from different perspectives. It differentiates between the right for acquiring human development, and the right for the opportunity to capitalise on knowledge and skills. The article examines human development based on a comprehensive literature survey with special focus on the UNDP HDI (Human Development Index). It concludes by emphasising the importance of securing the rights for achieving the highest possible development level for all citizens pointing out that actually this is also an economic interest. The economies and societies can only develop sustainably if a considerable human wealth, well-educated and healthy population is available, and the efficient deployment of these resources is facilitated by modern knowledgebased economic structures.

A cikk az emberi fejlettséget mint emberi jogot vizsgálja különböző szempontok szerint. Különbséget tesz az emberi fejlettséghez való hozzájutás joga és a tudás, valamint a képességek használatának lehetősége mint emberi jog között. Az emberi fejlettséget irodalmi áttekintés segítségével mutatja be, különös hangsúlyt fektetve az ENSZ humán fejlettségi indexére (HDI). Azt a következtetést vonja le, hogy egyrészről az egyénnek joga kell, hogy legyen a fejlettség lehető legmagasabb szintjének elérése, másrészről, hogy ez egyben gazdasági érdek is. A gazdaság és a társadalom ugyanis csak akkor tud fejlődni, ha jelentős humán vagyonnal, jól felkészült, egészséges lakossággal rendelkezik, és a korszerű társadalmi gazdasági szerkezet létrehozásával megteremti a humán vagyon hatékony foglalkoztatásának feltételeit.

The book “Dei delitti e delle pene” fundamentally set out the principles of modern criminal law today. Most attribute the origin and authorship of the book to Beccaria, but there have been many debates about its authorship in his day and later. In my study, I use the method of source criticism to analyse the memoirs of the “Öklök Társasága” and the recollections of individual members, I also examine several Hungarian translations, which introduces the debate around authorship from other aspects. In addition, in the study I present the method of torture discussed in the book from a historical and legal point of view, and with the help of a quantitative procedure I examine what proceedings have been going on in Hungary in connection with this crime in recent years and its tendencies. Is torture one of the means of authority in Hungary today, or is there no such restriction on the exercise of human and constitutional rights, and does the fulfilment of obligations also take place under the conditions specified by law?

A Dei delitti e delle pene című könyv alapjaiban határozta meg a mai modern büntetőjog alapelveit. A könyv eredetét és szerzőségét legtöbben Beccariának tulajdonítják, de annak szerzősége körül korában és később is számos vita alakult ki. Tanulmányomban a forráskritika módszerével az „Öklök Társaságának” emlékiratait, az egyes tagok visszaemlékezését is elemzés tárgyává teszem, több magyar nyelvű fordítást is megvizsgálok, amely a szerzőség körül kialakult vitát más aspektusból is megismerteti. Mindemellett a tanulmányban a könyvben tárgyalt kínvallatás módszerét történeti és jogi szempontból is bemutatom, valamint kvantitatív eljárás segítségével megvizsgálom, hogy Magyarországon e bűncselekménnyel kapcsolatban milyen eljárások voltak folyamatban az elmúlt években, azoknak mik a tendenciái. Vajon ma Magyarországon a kínvallatás a hatóság egyik eszköze, vagy az emberi és alkotmányos jogok gyakorlása érvényesül, és a kötelemteljesítés is törvényben meghatározott feltételek szerint alakul.

Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States requires Member
States, acting in accordance with their laws, to issue to their own nationals an identity card or passport stating their nationality in order that these persons can exercise that right. In this context, in Case C-490/20 Stolichna obshtina, rayon “Pancharevo”, which had been referred to it by the Bulgarian Courts, the Court of Justice was given the opportunity to precise the obligations on Member States not allowing parenthood for persons of the same sex regarding the right to free movement of an EU citizen child with parents of the same sex. By its judgment of 14 December 2021, the Court, on the one hand, ruled that, in the case of a child, being a minor, who is a Union citizen and whose birth certificate, issued by the competent authorities of the host Member State, designates as that
child’s parents two persons of the same sex, the Member State of which that child is a national is obliged to issue to that child an identity card or a passport without requiring a birth certificate to be drawn up beforehand by its national authorities. On the other hand, the Court set out that the Member State of which that child is a national is obliged to recognise, as is any other Member State, the document from the host Member State that permits that child to exercise, with each of those two persons, the child’s right to move and reside freely within the territory of the Member States.

Az Európai Unió (Unió) polgárainak és családtagjaiknak a tagállamok területén történő szabad mozgáshoz és tartózkodáshoz való jogáról szóló 2004/38/EK irányelv arra kötelezi a tagállamokat, hogy a jogszabályaikkal összhangban az állampolgáraik részére az állampolgárságot feltüntető személyazonosító igazolványt vagy útlevelet állítsanak ki annak érdekében, hogy azok gyakorolni tudják az Unió területén való szabad mozgáshoz és tartózkodáshoz való jogukat. Ezzel kapcsolatban a Bulgáriából érkezett C-490/20. sz. Stolichna obshtina, rayon „Pancharevo” ügyben a Bíróságnak alkalma volt pontosítani az irányelv alapján az azonos nemű szülőkkel rendelkező uniós polgár gyermek szabad mozgáshoz való jogából a gyermek állampolgársága szerinti, az azonos nemű személyek szülői jogállásának lehetőségét el nem ismerő tagállamra háruló kötelezettségeket. 2021. december 14-én meghozott ítéletében a Bíróság egyrészről megállapította, hogy az olyan uniós polgár kiskorú gyermek esetében, akinek a fogadó tagállam illetékes hatóságai által kiállított születési anyakönyvi kivonata a gyermek szüleiként két azonos nemű személyt tüntet fel, a gyermek állampolgársága szerinti tagállam köteles a gyermek számára személyazonosító igazolványt vagy útlevelet kiállítani, annak előzetes megkövetelése nélkül, hogy saját nemzeti hatóságai születési anyakönyvi kivonatot állítsanak ki. According to the Thai Immigration Act, refugees arriving to the country are illegal immigrants. The main reason for this is that the Kingdom has not yet ratified the 1951 Refugee Convention, thus it does not accept refugee applications, it does not recognise this status. The police can detain illegal residents and can initiate criminal proceedings against them. However, this vital topic of international dialogue is less known in Hungary. In our work, we review the local and international legal framework affecting the reality of the Thai refugee crisis, and point out the humanitarian crisis that has arisen through the enforcement of Thai law. Our paper is focused on the issue of legal protection that people who qualify as refugees under the Geneva Convention on Refugees can expect in a country that has not ratified the Convention and does not have an asylum system.

A thaiföldi bevándorlási törvény értelmében az országba érkező menekültek illegális bevándorlónak minősülnek. Ennek alapvető oka, hogy a délkeletázsiai királyság máig nem csatlakozott a genfi menekültügyi egyezményhez, így menekültkérelmeket nem fogad, e státuszt nem ismeri el. A jogszerűtlenül tartózkodókat a rendőrség idegenrendészeti őrizetbe veheti, ellenük büntetőeljárást kezdeményezhet. E nemzetközi dialógusban vitális téma azonban Magyarországon kevésbé ismert. Munkánkban a thai menekültügyi valóságot érintő helyi és nemzetközi jogi kereteket tekintjük át és mutatunk rá a thai jogalkalmazás révén kialakult humanitárius válságra. Írásunk fókusza arra a kérdésre irányul, hogy a genfi menekültügyi egyezmény meghatározása alapján menekültnek minősülő emberek milyen jogvédelemre számíthatnak egy olyan országban, amely nem rendelkezik menekültügyi rendszerrel.

Due to our proper socialisation, we turn to the disabled with the respect and acceptance that they deserve. Furthermore, our system of law pays special attention to the protection of their rights. The principle of positive discrimination is a highly important safeguard: it entitles them – along considering their conditions – to the most possible additional licences with which they can start their lives with (nearly) the same chances as their fellow citizens. Christianity, including the Catholic Church, played a key role in developing European attitude and right protection. In this study I am proving that the European right protection mechanism cannot be understood without the teaching of the Catholic Church on sick people. I am verifying my hypothesis from the points of view of theology, Canon Law, history of ideas and of arts. I am emphasising the differences between the aspect of fundamental law and the current theological teaching of the Church, which materialise the most clearly in the protection of the unborn child’s right to life.

Helyes európai szocializációnk folytán a fogyatékossággal élő emberekhez azzal a tisztelettel és elfogadással fordulunk, amely őket megilleti. Jogrendszerünk pedig különös figyelmet fordít jogaik védelmére. Fontos garanciális elem az úgynevezett pozitív diszkrimináció elve, amely állapotuk figyelembevétele mellett, a lehető legtöbb olyan többletjogosítvánnyal ruházza fel őket, amelyek segítségével többi polgártársaikhoz (közel) egyenlő eséllyel indulhatnak az életben. Az európai attitűd és jogvédelem kialakulásában azonban kulcsszerepet játszott a kereszténység és azon belül a katolikus egyház. Ebben a tanulmányban azt bizonyítom, hogy az európai jogvédelmi mechanizmus érthetetlen a katolikus egyház betegekről szóló tanítása nélkül. Hipotézisemet teológiai, kánonjogi, eszmetörténeti és művészeti szempontból igazolom. Különös hangsúlyt fektetek az alapjogi aspektusok és az egyház jelenlegi teológiai tanítása közötti különbözőségekre is, ami legkézzelfoghatóbban a magzati élet védelme területén ölt testet.

Between 1 June and 15 November 2021, the adjudicating and non-litigious panels of the Curia of Hungary examined the implementation of the following fundamental rights issues: the right to have one’s family life respected [Article VI, paragraph (1) of the Fundamental Law of Hungary], the right to access data of public interest [Article VI, paragraph (3) of the Fundamental Law of Hungary], the right to peaceful assembly [Article VIII, paragraph (1) of the Fundamental Law of Hungary], freedom of expression [Article IX, paragraph (1) of the Fundamental Law of Hungary], freedom of the press [Article IX, paragraph (2) of the Fundamental Law of Hungary], the right to property (Article XIII of the Fundamental Law of Hungary), the right to have one’s affairs handled impartially, fairly and within a reasonable time by the authorities [Article XXIV, paragraph (1) of the Fundamental Law of Hungary], the right to a fair trial [Article XXVIII, paragraph (1) of the Fundamental Law of Hungary] and the right to a judicial remedy [Article XXVIII, paragraph (7) of the Fundamental Law of Hungary].
