This study examines the citizen–citizen and citizen–state relationship focusing on the use of different languages in society. According to the basic assumption, there is necessarily a kind of competition between the different languages spoken in one state, which determines the relations between the languages. The development and maintenance of peaceful coexistence between languages (thus social groups of different languages) is part of the protection function of the state. This study examines the key points of intervention needed to develop appropriate language policy and legislation, which it summarises as the “law of coexisting languages”.

A tanulmány a társadalomban együtt élő nyelvek ember-ember és emberállam relációját vizsgálja. Az alapfeltevése szerint az egy államban beszélt különféle nyelvek között szükségszerűen egyfajta verseny alakul ki, amely meghatározza a nyelvek egymás közötti viszonyait. A nyelvek (így a különféle nyelvű társadalmi csoportok) közötti békés együttélés kialakítása az állam társadalomvédelmi funkciójába tartozik. E tanulmány a megfelelő nyelvpolitika és jogi szabályozás kialakításához szükséges sarkalatos beavatkozási pontokat vizsgálja, amelyet összegezve „együtt élő nyelvek jogának” nevez el.

Current international Human Rights obligations and language rights declarations have not proved particularly effective. For a crime against humanity a person may be sentenced to life imprisonment (e.g., Ratko Mladić for the Srebrenica massacre), but other perpetrators often go unpunished: for instance, most of those States which assimilate their linguistic minorities through submersion education programs. In his call for this conference, Professor György Andrássy urged us to find new arguments that might help to raise international language rights standards, and clarify the role of arguments in general. In this context I will address a wider issue: Does security policy pose a threat to minority language rights? These challenges have been highlighted by conflicts in Ukraine over the past five years. If the Council of Europe, the European Union, and NATO become complicit in Ukraine’s erosion of regional and minority languages, a precedent may be set whereby a linguistic minority can be deprived of the rights they previously enjoyed in their State. The example of Ukraine may be followed by other States in building homogeneous nation-states and could well lead to new conflicts in Europe. In this paper I will show that what has created a serious international conflict and paralysis in NATO could be handled quite straightforwardly by linguists.

A létező emberi jogi szabályozások és a nyelvi jogi szabályozások nem különösebben hatékonyak. Emberiesség elleni bűncselekmény és emberiesség elleni bűncselekmény között az az egyik különbség, hogy van, akit ilyen bűncselekményért életfogytig tartó börtönre ítélnek (Mladić), s van, akit futni hagynak (azoknak az államoknak a zömét, amelyek alámerítő oktatással asszimilálják nyelvi kisebbségeiket). A műhely-konferenciánkhoz írt tájékoztatójában Andrássy György a nyelvi jogok nemzetközi elismerésének magasabb szintre emeléséhez új érvek felkutatását szorgalmazta, s célként azt jelölte meg, hogy a tanácskozás „hozzájáruljon az ilyen érvek felkutatásához, bemutatásához és megvitatásához, illetve általában az érvek szerepének tisztázásához”. A nyelvi jogi érvek szerepének vizsgálatához egy tágabb kérdést is szóba kívánok most hozni: a kisebbségek nyelvi jogi védelmét veszélyeztetik-e biztonságpolitikai érdekek? Ezt a konfliktust éles reflektorfénybe állította Ukrajna az utóbbi öt évben. Ha az európai szervezetek passzivitásukkal bűnrészesek lesznek az ukrajnai regionális és kisebbségi nyelveken folyó oktatás erodálásában, az olyan precedenst teremthet, aminek következtében egy kisebbséget bármikor meg lehet fosztani azoktól a jogaitól, amelyeket korábban megszerzett egy államban. A homogén nemzetállamokat építő országokat Ukrajna példája arra sarkallhatja, hogy erre az útra lépjenek, ami új európai konfliktusokat eredményezhet. Be fogom mutatni, hogy ami súlyos nemzetközi konfliktushoz vezetett, és tanácstalanságot szült a NATO-ban, az nyelvészek számára elég könnyen kezelhető ügy lenne. A nyelvi emberi jogok és a biztonságpolitika szembeállítása csak pusztító hatású lehet. Viszont ezeknek a jogoknak és a biztonságpolitikai érdekeknek együttes érvényesítése lehetséges, és ez a konfliktuskezelés legjobb módja.

This paper examines three main arguments in favor of recognising language rights. According to one of them, linguistic diversity is an important and preservable value, language is a factor shaping identity. Another approach points out that linguistic diversity leads to conflict if different language communities have different rights to use their language. According to the third line of reasoning, language rights are a means of access to other human rights, of democratic participation, but they themselves can also be considered human rights. Whether we see language rights as a guarantee of a value to be protected, a useful conflict management tool or a human right, the regulation of the language issue cannot be left to the discretion of individual states: there is a need for a more effective role for the international community.

Jelen tanulmányban a nyelvi jogok elismerése mellett szóló három fő érvet vizsgálom. Ezek egyike szerint a nyelvi sokféleség fontos és megőrzendő érték, a nyelv identitásformáló tényező. Egy másik megközelítés rámutat, hogy a nyelvi különbözőség konfliktushoz vezet, amennyiben az egyes nyelvi közösségek eltérő jogokkal rendelkeznek nyelvük használatára. A harmadik érvelési irány szerint a nyelvi jogok a többi emberi joghoz való hozzáférés, a demokratikus részvétel eszközei, de önmagukban is emberi jogoknak tekinthetők. Akár egy védendő érték biztosítékának, akár hasznos konfliktuskezelési eszköznek, akár emberi jogoknak tekintjük a nyelvi jogokat, a nyelvi kérdés szabályozását nem lehet az egyes államok szabad belátására bízni: szükség van a nemzetközi közösség eddigieknél hathatósabb szerepvállalására is.

Territorial principle emerges not only in domestic legislations on language rights, but also in international documents. The article aims at offering an overview of the interpretations of territoriality in international documents relevant for minority language rights, with a special focus on the European Charter for Regional and Minority Languages and the Framework Convention for the Protection of National Minorities. While states often use territorial requirements as a tool of political control over minority language use, the interpretation of their obligations under the two Council of Europe treaties would require a more practical and technical approach to territorial limitations.

A területi elv nemcsak a nyelvi jogokra vonatkozó nemzeti jogszabályokban, hanem nemzetközi dokumentumokban is megjelenik. A cikk célja, hogy áttekintést nyújtson a kisebbségi nyelvi jogok szempontjából releváns nemzetközi dokumentumokban a területiség értelmezéséről, különös tekintettel a Regionális vagy Kisebbségi Nyelvek Európai Kartájára és a Nemzeti Kisebbségek Védelméről szóló Keretegyezményre. Míg az államok gyakran használják a területi követelményeket a kisebbségi nyelvhasználat feletti politikai ellenőrzés eszközeként, az Európa Tanács két szerződése szerinti kötelezettségeik értelmezése a területi korlátozások gyakorlatiasabb és technikai jellegű megközelítését tenné szükségessé.

Ethiopia is a multilingual country with federal form of state structure. The 1995 Constitution of the Federal Democratic Republic of Ethiopia (FDRE Constitution) gave equal recognition for all Ethiopian languages, but has chosen Amharic to become the working language of the Federal Government. In order to accommodate the needs of non-Amharic speakers in the provision of public services, the Constitution and other laws such as the Criminal Procedure Code, require the use of interpreters. Particularly in criminal proceedings, non-Amharic speakers are entitled to be assisted with a “qualified” interpreter to meaningfully participate in the cases. In practice, it is observed that accused people who do not speak the working language of the federal government are unable to effectively understand or get prompt and detailed information regarding the nature and effect of the case brought against them. Even if they know the case, they are not able to explain effectively their defences to the court or associated bodies, and thereby defend their rights. This study reveals that non-Amharic speakers are not served effectively according to the legal standards. This problem subsists mainly due to the absence or limited number of interpreters, as well as the use of untrained interpreters. Despite some efforts to address the problem, the federal government has not yet laid down any formal mechanism by which people with limited and/or no Amharic language proficiency are properly served in criminal proceedings both before and during trial. This study proposes the federal government to establish court interpreter training institutions, and to standardise court interpretation by allocating the necessary budget; lay down a formal mechanism such as enacting detailed laws and working manuals for assigning interpreters; providing other local languages the status of working language; consulting interpretation technologies and working in collaboration with different stakeholders.

Etiópia egy többnyelvű, szövetségi köztársaság államformával rendelkező ország. Az Etióp Demokratikus Szövetségi Köztársaság 1995-ös alkotmánya egyenlő elismerést biztosított valamennyi etiópiai nyelv számára, azonban az amhara nyelvet választotta a szövetségi kormány munkanyelvének. Annak érdekében, hogy az amhara nyelvet nem beszélő egyének igényeit kielégítsék a közszolgáltatások nyújtása során, az alkotmány és más törvények, mint a büntetőeljárási törvénykönyv, előírják a tolmácsok igénybevételét. Különösen a büntetőeljárások során, az amhara nyelvet nem beszélők jogosultak arra, hogy egy „szakképzett” tolmács segítse őket annak érdekében, hogy érdemben részt vegyenek az ügyekben. A gyakorlatban megfigyelhető, hogy a vádlottak, akik nem beszélik a szövetségi kormány munkanyelvét, nem képesek hatékonyan megérteni, illetve azonnali és részletes információt szerezni az ellenük indított ügy természetéről és hatásáról. Még ha ismerik is az ügyet, nem képesek hatékonyan kifejteni védekezésüket a bíróság vagy a kapcsolódó szervek előtt, ezáltal megvédeni saját jogaikat. Ez a tanulmány feltárja, hogy az amhara nyelvet nem beszélők nem részesülnek a jogi normáknak megfelelő eljárásban. Ez a probléma többnyire a tolmácsok hiánya, limitált száma vagy a képzetlen tolmácsok alkalmazása miatt marad fenn. A helyzet megoldásának érdekében tett lépések ellenére a szövetségi kormány még nem hozott létre egy olyan hivatalos mechanizmust, amellyel az amhara nyelvet korlátozottan és/vagy egyáltalán nem beszélő emberek megfelelő ellátásban részesülnének a büntetőeljárások során a tárgyalás előtt és a tárgyalás közben.
