Területi elv és a kisebbségi nyelvi jogokra vonatkozó nemzetközi normák

Absztrakt

A területi elv nemcsak a nyelvi jogokra vonatkozó nemzeti jogszabályokban, hanem nemzetközi dokumentumokban is megjelenik. A cikk célja, hogy áttekintést nyújtson a kisebbségi nyelvi jogok szempontjából releváns nemzetközi dokumentumokban a területiség értelmezéséről, különös tekintettel a Regionális vagy Kisebbségi Nyelvek Európai Kartájára és a Nemzeti Kisebbségek Védelméről szóló Keretegyezményre. Míg az államok gyakran használják a területi követelményeket a kisebbségi nyelvhasználat feletti politikai ellenőrzés eszközeként, az Európa Tanács két szerződése szerinti kötelezettségeik értelmezése a területi korlátozások gyakorlatiasabb és technikai jellegű megközelítését tenné szükségessé.
