Introduction: The significance of the frauds committed using the information system in the Hungarian criminal law has gradually increased in parallel with the progress of digitalization. However, it is not clear whether it is justified to maintain criminalization at the criminal level in cases of low value and marginal danger to society, and whether this is in line with the ‘ultima ratio’ nature of criminal law.

Aims: The aim of the study is to examine whether the current regulation of fraud committed using the information system is proportionate in cases of low value and minor importance, or whether the introduction of the misdemeanor structure would be justified.

Methodology: The methodological basis of the research is the dogmatic and normative analysis of a specific legal case – which can be labeled as trivial by the public opinion. During the study, an overview of the substantive criminal law and misdemeanor law is followed by an analysis of the specific legal case. The study covers the comparison of thresholds, qualified cases and penalty items, and also takes into account the relevant provisions of the Budapest Convention on Cybercrime.

Results: The study emphasizes that in the examined legal case – where the damage caused was negligible – the act is classified as a severe crime solely due to the manner of commission, while acts committed in a ‘traditional’ manner for the same or higher value are assessed as a misdemeanor. It can be stated that the current regulation does not ensure differentiation based on the social danger of the committing behavior, the perpetrator’s level of consciousness and IT skills. It can also be noted that in the case under analysis, the procedural costs may disproportionately exceed the extent of the damage caused. It can also be shown that the spread of certain technical security systems (exit gates) in stores actually creates a situation in which, instead of ‘classic’ theft, influencing the operation of the information system becomes the only realistic form of offense. The study also raises the need for a revision of the Budapest Convention.

Conclusion: The primary lesson of the research is that the current, undifferentiated regulation of fraud committed using the information system may violate the ultima ratio nature of criminal law and the requirement of proportionality in cases of low value of the offense. Another important finding is that the technical nature of the method of commission does not in itself justify criminal-level sanctions if the danger to society is negligible. Future legislative and criminal policy research may be justified in considering the introduction of a threshold-based offense form and the revision of the Budapest Convention from a proportionality perspective.

Bevezetés: Az információs rendszer felhasználásával elkövetett csalás tényállásának jelentősége a magyar büntetőjogban a digitalizáció előrehaladásával párhuzamosan fokozatosan megnövekedett. Nem tisztázott azonban, hogy a csekély elkövetési értékű, marginális társadalomra veszélyességű esetekben indokolt-e a bűncselekményi szintű kriminalizáció fenntartása, összhangban áll-e ez a büntetőjog ultima ratio jellegével.

Célkitűzések: A tanulmány célja annak vizsgálata, hogy az információs rendszer felhasználásával elkövetett csalás hatályos szabályozása arányos-e csekély elkövetési értékű, kisebb jelentőségű ügyekben vagy indokolt lenne a szabálysértési alakzat bevezetése.

Módszertan: A kutatás módszertani alapját egy konkrét – a közvélemény által bagatell jelentőségűnek bélyegezhető – jogeset dogmatikai és normatív elemzése képezi. A vizsgálat során az anyagi büntetőjogi (Btk.) és szabálysértési jogi szabályozás (Szabs. tv.) áttekintését a konkrét jogeset elemzése követi. A tanulmány kiterjed az értékhatárok, a minősített esetek, valamint a büntetési tételek összevetésére, továbbá figyelembe veszi 2001. évi budapesti egyezmény releváns rendelkezéseit.

Eredmények: A tanulmány arra helyezi a hangsúlyt, hogy a vizsgált jogesetben – ahol az okozott kár elenyésző mértékű volt – a cselekmény kizárólag az elkövetési mód miatt minősül bűntettnek, miközben az azonos vagy magasabb értékre, „hagyományos” módon elkövetett cselekményeket szabálysértésként bírálják el. Megállapítható, hogy a jelenlegi szabályozás nem biztosítja a differenciálást az elkövetési magatartás társadalomra veszélyessége, az elkövető tudattartalma és informatikai jártassága alapján. Rögzíthető továbbá, hogy az elemzés tárgyát képező esetben az eljárási költségek aránytalanul meghaladhatják az okozott kár mértékét. Az is kimutatható, hogy az egyes áruházi technikai védelmi rendszerek (kiléptető kapuk) elterjedése ténylegesen olyan helyzetet teremt, amelyben a „klasszikus” lopás helyett az információs rendszer működésének befolyásolása válik az egyetlen reális elkövetési alakzattá. A tanulmány felveti továbbá a budapesti egyezmény reviziójának szükségességét.

Konklúzió: A kutatás elsődleges tanulsága, hogy az információs rendszer felhasználásával elkövetett csalás jelenlegi, differenciálatlan szabályozása csekély elkövetési értékű esetekben sértheti a büntetőjog ultima ratio jellegét és az arányosság követelményét. További fontos megállapítás, hogy az elkövetési mód technikai jellege önmagában nem indokolja a bűncselekményi szintű szankcionálást, ha a társadalomra veszélyesség elenyésző mértékű. A jövőbeni jogalkotási és kriminálpolitikai kutatások számára indokolt lehet egy értékhatárhoz kötött szabálysértési alakzat bevezetésének, illetve a budapesti egyezmény arányossági szempontú felülvizsgálatának megfontolása.

As the number of cybersecurity threats continues to increase and the technological environment evolves, organizations widely adopt various standards to reduce risks and support compliance. However, few comparisons use a uniform set of criteria and also assess the approaches’ practical applicability and their ability to align with one another. With this in mind, the study specifically examines under what environmental conditions certain standards provide effective support.

The objective of the study is to present, in a synthesizing manner, the COBIT 2019, NIST CSF, C2M2, and ISO/IEC 27001:2022 standards, to compare them along selected attributes, and to illustrate the dilemmas of selection and implementation through a practical case study.

First, the authors define the conceptual boundaries of IT security and cybersecurity, emphasizing that cybersecurity is relevant not only for technical reasons but also from the perspective of organizational and managerial responsibility. Next, they outline COBIT 2019’s IT-governance-focused approach, which centers on maturity levels and performance measurement, and discuss the NIST CSF’s risk-based, industry-agnostic, modular structure. They also present the C2M2 maturity model optimized for critical infrastructures, as well as the certifiable ISMS requirements of ISO/IEC 27001:2022. To compare the standards, the authors developed a bespoke evaluation framework, which assesses the systems’ objectives, applicability, certifiability, industry focus, and implementation complexity, while also underscoring that there is no single “best solution” suitable for all organizations, since selection must take into account, among other factors, an organization’s specific goals and risk profile. As a complementary element, the article includes a case study that aims to illustrate the challenges of practical implementation and the need to formulate improvement recommendations through a gap analysis against ISO/IEC 27001:2022 conducted at a large industrial enterprise.

Based on the comparative analysis, the authors highlight that COBIT 2019 can provide a high level of support for aligning corporate IT governance with business objectives and incorporates a maturity perspective; however, it is not certifiable. Owing to its modular structure and industry-agnostic nature, the NIST CSF is particularly well-suited to managing cybersecurity risks. Although it does not rely on a maturity-based approach, it has the advantage of being able to be maintained alongside other standards. The strength of C2M2 lies in assessing the maturity of critical infrastructure and clearly identifying areas for improvement, and it is applicable not only to IT but also to OT environments. The formal requirements of an Information Security Management System (ISMS) are primarily based on ISO/IEC 27001:2022, which provides the implementing organization with a risk-based control system. Due to its certifiability and wide recognition, it can be regarded as a trust-building instrument in establishing and maintaining business relationships. It should be noted, however, that its implementation may require substantial resources, primarily because of administrative burdens. Complementing these findings, the case study shows that, in a large-enterprise IT environment, a gap analysis requires a deliberate definition of scope and prioritization based on system criticality; otherwise, conducting it may entail disproportionate resource expenditure. As a practical outcome, a structured classification of gaps was developed, which directly supported mitigating high risks, identifying areas with significant improvement potential, and preparing a prioritized action plan.

The most important conclusion of the study is that, also in the context of cybersecurity compliance, there is no single “best solution” that fits all organizations, since the choice must consider, among other factors, an organization’s specific objectives and risk profile; therefore, in many cases, the parallel or combined application of frameworks may deliver the greatest value. Accordingly, the authors identify, as a direction for future research, the development of methodologies that support, in a measurable way, the integration of different standards.

Bevezetés: A kiberbiztonsági fenyegetések száma folyamatos növekedésének és a technológiai környezet változásainak hatására a szervezetek széles körben alkalmaznak különböző sztenderdeket a kockázatok csökkentésére és a megfelelés támogatására. Ugyanakkor kevés olyan, egységes szempontrendszer szerint végzett összehasonlítás áll rendelkezésre, amely kiterjed a megközelítések gyakorlati alkalmazhatóságának és egymáshoz illeszthetőségének értékelésére is. Erre figyelemmel a tanulmány kifejezetten azt vizsgálja, hogy bizonyos sztenderdek milyen környezeti feltételek fennállása esetén adnak hatékony támogatást.

Célkitűzések: A tanulmány célja a COBIT 2019, a NIST CSF, a C2M2 és az ISO/IEC 27001:2022 sztenderdek ismertetése szintetizáló jelleggel, valamint egyes attribútumok mentén azok összehasonlítása, továbbá egy gyakorlati esettanulmányon keresztül a kiválasztás és bevezetés dilemmáinak szemléltetése.

Módszertan: A szerzők mindenekelőtt rögzítik az informatikai biztonság és a kiberbiztonság fogalmi kereteit, kiemelve, hogy a kiberbiztonságnak nem kizárólag technikai okok miatt, hanem a szervezeti és a vezetői felelősség szempontjából is relevanciája van. Ezt követően ismertetik a COBIT 2019 IT-irányítási fókuszú, érettségi szinteket és teljesítménymérést középpontba helyező megközelítését, illetve kitérnek a NIST CSF kockázatalapú, iparágfüggetlen, moduláris felépítésére, bemutatják továbbá a C2M2 kritikus infrastruktúrákra optimalizált érettségi modelljét, valamint az ISO/IEC 27001:2022 tanúsítható ISMS-követelményeit. A sztenderdek összehasonlításához egyedi szempontrendszert dolgoztak ki, amelynek segítségével értékelik a rendszerek célját, alkalmazhatóságát, tanúsíthatóságát, iparági fókuszát és implementációs összetettségét, rámutatva egyúttal arra is, hogy nem létezik egy valamennyi szervezet számára egységes „legjobb megoldás”, hiszen a választás alkalmával figyelemmel kell lenni többek között a szervezet egyedi céljaira és a kockázati profiljára. A cikk kiegészítő jelleggel tartalmaz egy esettanulmányt, amelyben a szerzők egy ipari nagyvállalat ISO/IEC 27001:2022 szerinti eltéréselemzésén keresztül kívánják szemléltetni a gyakorlati megvalósítással járó kihívásokat, valamint a fejlesztési javaslatok megfogalmazásának szükségességét.

Eredmények: Az összehasonlító elemzés eredményeként a szerzők rávilágítottak, hogy a COBIT 2019 a vállalati IT-irányítás és az üzleti célok összehangolásában képes magas fokú támogatást biztosítani, illetve az érettségi szemlélet is érvényesül, ugyanakkor tanúsításra nincs lehetőség. A NIST CSF moduláris felépítésének és iparágfüggetlen jellegének köszönhetően kifejezetten alkalmas a kiberbiztonsági kockázatok kezelésének elősegítésére. A rendszer érettségalapú megközelítéssel ugyan nem bír, de előnyének tekinthető, hogy más sztenderdekkel együtt is fenntartható. A C2M2 erőssége a kritikus infrastruktúrák érettségi szintjének vizsgálata és a fejlesztési területek egyértelmű azonosítása úgy, hogy az IT mellett az OT-környezetre is ráilleszthető. Az Információbiztonsági Irányítási Rendszer (ISMS) formális követelményei elsődlegesen az ISO/IEC 27001:2022 szabványra épülnek, egy kockázatalapú kontrollrendszert bocsátva az alkalmazó szervezet rendelkezésére. A tanúsíthatósága és széles körű ismertsége miatt bizalomépítő eszközként lehet rá tekinteni az üzleti kapcsolatok létesítése és fenntartása során. Ugyanakkor megállapítható, hogy az implementációja jelentős erőforrás-ráfordítást igényelhet, főként az adminisztratív terhek miatt. Ezt kiegészítve, az esettanulmány rámutatott arra, hogy nagyvállalati IT-környezetben végzett eltéréselemzéshez szükséges a hatókör tudatos megállapítása, valamint a rendszerkritikusságon alapuló priorizálás, ellenkező esetben annak elvégzése aránytalan erőforrás-ráfordítással járhat. A vizsgálat gyakorlati eredményeként létrejött az eltérések strukturált minősítése, ami közvetlenül segítette a magas kockázatok mérséklését, a jelentős fejlesztési potenciállal rendelkező területek azonosítását, valamint egy priorizált intézkedési terv összeállítását.

Konklúzió: A tanulmány legfontosabb tanulsága, hogy a kiberbiztonsági megfelelés tekintetében sem létezik egy valamennyi szervezet számára egységes „legjobb megoldás”, hiszen a választás során figyelemmel kell lenni többek között a szervezet egyedi céljaira és a kockázati profiljára, így sok esetben a keretrendszerek együttes vagy kombinált alkalmazása adhatja a legnagyobb értéket. Erre figyelemmel a szerzők jövőbeli kutatási irányként határozták meg olyan módszertanok kidolgozását, amelyek mérhető módon támogatják a különböző sztenderdek integrációját.

Introduction: Festival tourism is one of the most dynamically developing sectors of the modern tourism industry, exerting a significant impact on the economy and national image building. At the same time, due to their nature, mass events are increasingly exposed to the threats of global terrorism.

Aim of the study: To analyze the security of festival tourism, with a particular focus on terrorist threats. The study examines international security trends, relevant events after 2020, the situation in Hungary, and the legislative and institutional responses regarding the terrorist threats to festival tourism.

Methodology: The research is based on a complex methodology. It includes an analysis of specialized literature and legislation, the processing of three international case studies from after 2020 (Israel, Russia, Austria), and three qualitative in-depth expert interviews.

Results: The analysis reveals that the success of attacks against festivals can often be attributed to the misinterpretation of intelligence (e.g., "wishful thinking"), coordination deficiencies, or infrastructural failures. In Hungary, the bipolar model of counter-terrorism and the on-site, integrated securing of events create a security environment that is outstanding even by global standards. One of the study's key findings is that, alongside physical protection, the development of security awareness at a societal level is essential for averting future threats. Radicalization in the online space and the expansion of the "dark web" require new types of detection methods from authorities, which can only be maintained through continuous technological and methodical renewal. The summary emphasizes that the festival experience and high-level security are not mutually exclusive but rather reinforcing factors, based on strict professional protocols.

Conclusions: In the future, further strengthening of technology-based detection and international intelligence cooperation is necessary to maintain or enhance the security level of festival tourism. The study concludes that festival security is based on the symbiosis of organizational expertise, official precision, and participant security awareness. It is essential to continuously increase the security awareness of both organizers and authorities, while also forming and strengthening the security-conscious mindset of visitors. In the fight against terrorism, there is no room for half-measures. It is a fundamental principle that every piece of information and suspicious sign must be thoroughly investigated and clarified. This complex approach guarantees that festival tourism in Hungary remains not only an economic success but also represents a world-class, model-value system in terms of security at the European level.

Bevezetés: A fesztiválturizmus a modern turizmusipar egyik legdinamikusabban fejlődő ágazata, amely jelentős gazdasági és országimázs-építő hatást gyakorol. Ugyanakkor a tömegrendezvények jellegükből adódóan fokozottan ki vannak téve a globális terrorizmus fenyegetésének.

A tanulmány célja: A fesztiválturizmus biztonságának elemzése, különös tekintettel a terrorfenyegetettségre. A tanulmány vizsgálja a nemzetközi biztonsági trendeket, a 2020 utáni releváns eseményeket, valamint a magyarországi helyzetet és a jogszabályi, intézményi válaszokat a fesztiválturizmus terrorfenyegetettsége kapcsán.

Módszer: A kutatás komplex módszertanra épül. Tartalmazza a szakirodalmi és a jogszabályi elemzést, három, 2020 utáni nemzetközi esettanulmány (Izrael, Oroszország, Ausztria) feldolgozását, valamint három kvalitatív szakértői mélyinterjút.

Eredmények: Az elemzés feltárja, hogy a fesztiválok elleni támadások sikere gyakran a hírszerzési információk helytelen értelmezésére (például vágyvezérelt gondolkodás), koordinációs hiányosságokra vagy infrastrukturális hibákra vezethető vissza. Magyarországon a terrorizmus elleni küzdelem kétpólusú modellje és a rendezvények helyszíni, integrált biztosítása világviszonylatban is kiemelkedő biztonsági környezetet teremt. A tanulmány egyik legfontosabb megállapítása, hogy a fizikai védelem mellett a biztonságtudatosság össztársadalmi szintű fejlesztése is elengedhetetlen a jövőbeli fenyegetések elhárításához. Az online térben zajló radikalizáció és a dark web térnyerése új típusú felderítési módszereket követel meg a hatóságoktól, amit csak folyamatos technológiai és metodikai megújulással lehet követni. Az összegzés hangsúlyozza, hogy a fesztiválélmény és a magas szintű biztonság nem egymást kizáró, hanem egymást erősítő tényezők, amelyek alapját a szigorú szakmai protokollok adják.

Következtetések: A jövőben a technológiai alapú felderítés és a nemzetközi hírszerzési együttműködés további erősítése szükséges a fesztiválturizmus biztonságának szinten tartása/fokozása érdekében. A tanulmány konklúziója, hogy a fesztiválok biztonsága a szervezői szakértelem, a hatósági precizitás és a résztvevői biztonságtudatosság szimbiózisán alapul. Elengedhetetlen a szervezői és a hatósági biztonságtudatosság folyamatos növelése, amely mellett fontos a látogatói kör biztonságtudatos szemléletmódjának formálása és erősítése. Introduction: Fire tragedies in entertainment venues are often caused by identifiable, recurring risk factors; therefore, they must be examined not only from the perspectives of fire safety and criminal law, but also from the perspectives of police science and criminology.

Objectives: This study aims to highlight that fires in entertainment venues resulting in mass casualties are not merely fire safety or criminal law issues, but social problems that must also be understood from the perspectives of law enforcement science, criminology, and private security. The research focuses on negligence, regulatory gaps, integrity risks, and the preventive role of private security.

Methodology: The study examines five internationally documented fires at entertainment venues using a qualitative, comparative case study methodology.

Results: The tragedies under investigation were not caused by isolated individual failures, but rather by an interlocking system of deficiencies in licensing, operations, oversight, and safety management.

Conclusion: This study may help us view the prevention of mass tragedies caused by fires in entertainment venues as a collective achievement in public safety. In this regard, government authorities, venue operators, and private security service providers share complementary responsibilities.

Bevezetés: A szórakozóhelyi tűztragédiák hátterében gyakran előzetesen felismerhető, ismétlődő kockázati tényezők állnak, ezért azok nem csupán tűzvédelmi vagy büntetőjogi, hanem rendészettudományi és kriminológiai szempontból is vizsgálandók.

Célkitűzések: A tanulmány arra kíván rámutatni, hogy a tömeges áldozattal járó szórakozóhelyi tűzesetek nem csupán tűzvédelmi vagy büntetőjogi események, hanem rendészettudományi, kriminológiai és magánbiztonsági szempontból is értelmezendő társadalmi problémák. A kutatás középpontjában a gondatlanság, az ellenőrzési hiányosságok, az integritási kockázatok és a magánbiztonság prevenciós szerepe áll.

Módszertan: A vizsgálat öt, nemzetközi szinten dokumentált szórakozóhelyi tűzesetet dolgoz fel kvalitatív, összehasonlító esetelemzés módszerével.

Eredmények: A vizsgált tragédiák hátterében nem elszigetelt egyéni mulasztások, hanem engedélyezési, üzemeltetési, ellenőrzési és biztonságszervezési hiányosságok egymásra épülő rendszere azonosítható.

Konklúzió: A tanulmány hozzájárulhat ahhoz, hogy a szórakozóhelyi tűzeseti tömegtragédiák megelőzését a közbiztonság közös eredményeként értelmezzük. Ebben az állami hatóságok, az üzemeltetők és a magánbiztonsági szolgáltatók egymást kiegészítő felelősséggel rendelkeznek.

Objectives: The publication presents the official German federal police statistics for 2024. Readers can learn about the methodology used to compile the report and the most important sections, figures and comparisons with the previous year. The paper also discusses the impact of the new cannabis law and the criminal situation of non-Germans. It presents the percentage of certain specific crimes within the total number of cases, as well as their numerical distribution.

Methodology: The basic method used in the study was the examination and analysis of German crime statistics and related documents and commentaries. It is important to compare crime statistics with those of previous years in order to identify certain trends.

Results: Readers can access a large amount of official data on crime statistics, which they can compare with their own knowledge. They can also gain insight into issues such as the significant number of foreign, non-German criminals and the occurrence of certain types of crimes in other countries.

Olyan problémákba is betekintést nyerhet, mint a jelentős számú külföldi, nem német bűnözési helyzete, illetve egyes speciális bűncselekmény fajták egy másik országban történő jelentkezése.

Konklúzió: A németországi bűnügyi viszonyok jelenleg alapvetően kiegyensúlyozottnak tűnnek. Nincsenek kiugró hátrányos adatok. A dokumentumok reális helyzetelemzést tükröznek, nem látszik a számok manipulatív értelmezése, a felderítési kvóták nem tükröznek túlbonyolítást. Néhány bűncselekmény fajta esetében, bár csak apró lépésekben, de folyamatos a helyzet romlása. Ezek megoldásában hosszabb távon változás szükséges.

Introduction: Peer bullying has long been a central focus of educational sciences, psychology, and criminology; however, it is rarely examined within broader social and historical contexts. This study is based on the assumption that aggressive behavioral patterns among young people are not isolated phenomena but rather reflections of wider social communication and power dynamics.

Aims: The author’s aim is to explore the structural and dynamic similarities between the processes of peer bullying and the mechanisms underlying the emergence of genocidal regimes, with particular attention to normalization processes, actor roles, and the role of societal indifference.

Methodology: The study is based on a qualitative methodology, employing a literature-based analysis and thematic review. Through a comparative examination of selected theoretical models, the analysis focuses on processual characteristics, the stabilization of social roles, and recurring communication patterns.

Results: The analysis demonstrates that bullying and genocidal processes share several structural similarities, including the dehumanization of victims, the passive role of bystanders, the gradual legitimization of aggression, and institutional or community-level silence. These factors appear as decisive elements in both phenomena.

Conclusion: The study concludes that reducing violence among young people is not solely a pedagogical or disciplinary issue but a matter of broader societal responsibility. Communication patterns amplified by the digital environment further underscore the need for society-wide efforts to promote more conscious, tolerant, solidaristic, and morally consistent forms of communication. The primary contribution of this study lies in drawing attention - among the first in the field - to the parallels between peer bullying and genocidal processes, thereby expanding the interpretative framework of bullying research.

Bevezetés: A kortársbántalmazás (bullying) jelensége hosszú ideje a neveléstudomány, a pszichológia és a kriminológia fókuszában áll, ugyanakkor ritkán elemzik tágabb társadalmi és történeti összefüggésekben. Jelen tanulmány abból a feltevésből indul ki, hogy a fiatalok közötti agresszív viselkedési mintázatok nem elszigetelt jelenségek, hanem szélesebb társadalmi kommunikációs és hatalmi folyamatok leképeződései.

Célkitűzés: A tanulmány szerzőjének célja annak feltárása volt, hogy milyen strukturális és dinamikai hasonlóságok figyelhetők meg a kortársbántalmazás folyamatai és a népirtó rezsimek kialakulásának mechanizmusai között, különös tekintettel a normalizációra, a szereplői pozíciókra és a társadalmi közöny szerepére. 

Módszertan: A vizsgálat kvalitatív módszertanon alapuló irodalmi feldolgozás és tematikus áttekintés formájában valósult meg. A kiválasztott elméleti modellek összehasonlító elemzése során a hangsúly a folyamatjelleg, a szerepek stabilizálódása és a kommunikációs minták vizsgálatán volt.

Eredmények: Az elemzés rámutat arra, hogy a bullying és a népirtó folyamatok számos ponton strukturális azonosságokat mutatnak: az áldozatok dehumanizációja, a passzív szemlélők szerepe, az agresszió fokozatos legitimálódása, valamint az intézményi vagy közösségi szintű hallgatás mindkét esetben meghatározó tényező.

Konklúzió: A tanulmányban tett következtetések szerint a fiatalok közötti erőszak csökkentése nem kizárólag pedagógiai vagy fegyelmezési kérdés, hanem szélesebb társadalmi felelősség. A digitális tér által felerősített kommunikációs minták különösen indokolttá teszik, hogy a társadalom egészének kommunikációja tudatosabbá, toleránsabbá, szolidárisabbá és erkölcsileg következetesebbé váljon. A tanulmány elsősorban erre a felelősségre kíván rámutatni, ebből fakad azon értéke, hogy a szerző elsők között irányítja rá a figyelmet a két folyamat közötti strukturális hasonlóságra.

Introduction: Recreational drug use in the context of music festivals and the associated drug-related crimes have long been recognized as a phenomenon; however, the reliability of the picture conveyed by official crime statistics regarding this phenomenon is disputed. It remains poorly understood how the specific characteristics of the festival environment contribute to the latency of drug-related crimes and to what extent recorded data distort actual processes.

Objectives: The aim of this study is to explore the latent nature of drug-related crimes in the context of music festivals, as well as to evaluate the suitability of official crime statistics for capturing these phenomena.

Methodology: The research is based on a quantitative analysis of official crime statistics (ENyÜBS) as well as a qualitative textual analysis of final court judgments, case studies, and rulings. Focusing on the concept of latency, the study analyzes the modus operandi, spatial and temporal characteristics, and typical profiles of perpetrators in drug-related cases uncovered at festival venues.

Results: The results show that the number of drug-related crimes recorded at music festivals falls significantly short of the presumed actual incidence. Criminal statistics severely underrepresent the extent of violations, particularly in the case of international and organized distribution activities. It can also be concluded that the intensity of police presence and the control strategies employed have a direct impact on the number of recorded cases, resulting in significant statistical distortion.

Conclusion: The most important finding of the study is that the majority of drug-related crimes committed in a festival environment remain unreported, meaning that official statistics alone are insufficient to illustrate the true extent of the phenomenon. The results highlight the role of law enforcement interventions in influencing data, as well as the need to rethink the methodology of prevention and detection. For future research, it is advisable to strengthen multidisciplinary approaches and systematically incorporate alternative data sources. The methodological and theoretical integration of different academic disciplines can contribute to a more complex interpretation of the phenomena under study, while the use of new types of data sources creates opportunities to increase the reliability and validity of research findings.

Bevezetés: A zenei fesztiválok kontextusában megjelenő rekreációs droghasználat és az ehhez kapcsolódó kábítószerrel összefüggő bűncselekmények jelenléte régóta ismert jelenség, ugyanakkor a jelenségről a hivatalos bűnügyi statisztikák által közvetített kép megbízhatósága vitatott. Kevéssé feltárt, hogy a fesztiválkörnyezet sajátosságai miként járulnak hozzá a kábítószerrel összefüggő bűncselekmények látenciájához, és mennyiben torzítják a regisztrált adatok a valós folyamatokat.

Célkitűzések: A tanulmány célja feltárni a kábítószerrel kapcsolatos bűncselekmények látens természetét a zenei fesztiválok kontextusában, valamint értékelni a hivatalos bűnügyi statisztikák alkalmasságát e jelenségek leképezésére.

Módszertan: A kutatás a hivatalos bűnügyi statisztika (ENyÜBS) kvantitatív elemzésére, valamint jogerős bírósági ítéletek, esettanulmányok és határozatok kvalitatív szövegelemzésére épül. A vizsgálat a látencia fogalmára fókuszálva elemzi a fesztiválhelyszíneken feltárt kábítószeres ügyek elkövetési módját, tér- és időbeli jellemzőit, valamint az elkövetők tipikus profilját.

Eredmények: Az eredmények azt mutatják, hogy a zenei fesztiválokon regisztrált kábítószeres bűncselekmények száma jelentősen elmarad a feltételezett valós előfordulástól. A bűnügyi statisztikák súlyosan alul reprezentáljak a jogsértések mértékét, különösen a nemzetközi és szervezett terjesztői tevékenységek esetében. Megállapítható továbbá, hogy a rendőri jelenlét intenzitása és az alkalmazott ellenőrzési stratégiák közvetlen hatással vannak a regisztrált esetek számára, ami jelentős statisztikai torzítást eredményez.

Konklúzió: A tanulmány legfontosabb tanulsága, hogy a fesztiválkörnyezetben elkövetett kábítószeres bűncselekmények többsége látens marad, így a hivatalos statisztikák önmagukban nem alkalmasak a jelenség valós kiterjedésének bemutatására. Az eredmények rámutatnak a rendészeti beavatkozások adatbefolyásoló szerepére, valamint a prevenció és felderítés módszertani újragondolásának szükségességére. A különféle tudományterületek integrációja elősegíti a jelenségek átfogóbb értelmezését, míg az új adatforrások erősítik a kutatási eredmények megbízhatóságát és érvényességét.

Introduction: In modern democratic states, the social legitimacy of policing is a fundamental condition of effective law enforcement. The evaluation of police activity is therefore not solely a legal issue but is inseparably linked to ethical considerations that directly influence public trust and policing effectiveness.

Objectives: This study examines how ethically grounded policing contributes to the effectiveness and social legitimacy of the police. The analysis focuses on the normative identity of the police profession, the ethical dilemmas of discretionary decision-making, and the consistent protection of human dignity.

Method: The study applies a theoretical and normative approach. Its methodological basis consists of a systematic review of relevant national and international literature and a normative analysis of the Police Code of Ethics, with particular attention to its role as an internal guide complementing legal regulation in discretionary decision-making.

Results: The findings demonstrate that policing effectiveness and legitimacy depend significantly on the ethical quality of police decision-making. The legitimate exercise of discretion is ensured not by limiting discretion itself, but by grounding it in ethical principles such as proportionality, fairness, the duty to give reasons, and respect for human dignity. The application of procedural justice principles strengthens public trust and citizens’ willingness to cooperate. The study proposes a conceptual model of ethically grounded policing, identifying key conditions through which legitimacy and effectiveness are mutually reinforced.

Conclusions: The study concludes that ethical commitment does not constrain policing effectiveness but reinforces it by enhancing legitimacy and public trust. Ethics is therefore not a supplementary element but a fundamental precondition of modern, democratic policing.

Bevezetés: A modern demokratikus állam működésének alapfeltétele a rendészet társadalmi legitimitása. A rendőrség tevékenységének megítélése ezért nem kizárólag jogi, hanem elválaszthatatlanul etikai kérdés is, amely közvetlen hatással van a közbizalomra és a rendészeti hatékonyságra.

Célkitűzések: A tanulmány célja annak bemutatása, hogy az etikai alapokon nyugvó rendészeti működés miként járul hozzá a rendőrség hatékonyságának és társadalmi legitimitásának erősítéséhez. A vizsgálat középpontjában a rendőri hivatás normatív identitása, a diszkrecionális döntéshozatal etikai dilemmái, valamint az emberi méltóság következetes védelmének szerepe áll.

Módszer: A tanulmány elméleti-normatív megközelítést alkalmaz. A vizsgálat módszertani alapját a releváns hazai és nemzetközi szakirodalom feldolgozása, valamint a Rendőrségi Etikai Kódex normatív dokumentumelemzése képezi, különös tekintettel annak a jogi szabályozást kiegészítő orientáló funkciójára.

Eredmények: Az elemzés rámutat arra, hogy a rendészeti hatékonyság és legitimitás jelentős mértékben függ a rendőri döntéshozatal etikai minőségétől. A diszkrecionális döntések legitim működését az etikai normák – különösen az arányosság, a méltányosság, az indokolási kötelezettség és az emberi méltóság tisztelete – biztosítják. Az eljárási igazságosság elveinek érvényesülése növeli az állampolgári együttműködést és a közbizalmat. A tanulmány egy etikai alapú rendészeti modellt vázol fel, amely azonosítja azokat a kulcsfeltételeket, amelyek révén a legitimitás és a hatékonyság egymást erősítő módon kapcsolódik össze.

Következtetések: A tanulmány következtetése szerint az etikai elköteleződés nem korlátozza, hanem megerősíti a rendészeti hatékonyságot és a társadalmi legitimitást. Az etika nem kiegészítő eleme, hanem alapfeltétele a modern, demokratikus rendészeti működésnek.

Aim: The aim of my study is to highlight that, when examining a successful professional career path, whether in the civilian sector or, as in the present case, in the field of law enforcement, the underlying social regularities are often incorrectly disregarded, and the answers regarding the reasons for success are simply sought in chance, luck, or personal connections.

When we see an unsuccessful or less than ideally developing professional career before us, we tend to look for the reasons for the lack of success simply in the lack of individual diligence or in inappropriate lifestyle. Of course, the cause of neither situation can be described with such a simple formula.

Methodology: A certain part of the necessary components of success is indeed provided by the totality of the factors listed above, and a significant part of the failure can undoubtedly be traced back to the diligence of the individual. When the truly difficult problem of success and failure is related to a person belonging to a minority, who is at risk of a conflicted life path and is otherwise exposed to poverty or failure in the labor market, all the root causes and possible solutions to the problem can be explained by exponentially complex social laws.

Value: Knowing the situation in Hungary, it can be emphatically stated that in the case of people of Roma origin currently working in various positions in the police force, the first step on the path to success is to achieve human and professional self-confidence and its continuous increase. The path to success can be clearly and well described with the help of social and sociological laws. Avoiding professional failure can also be achieved in substance by adhering to the same principles and rules.

Conclusion: The question of success has long been a central topic in social science, economic and cultural analyses. In public discourse and meritocratic narratives, success is often presented as a result of individual performance, which assumes that outstanding performance leads to proportionally greater recognition. However, numerous empirical observations indicate that the same or similar performance can lead to different levels of success, which draws attention to the complexity of the relationship between performance and success.

Cél: Tanulmányom célja, rámutatni arra, hogy egy sikeres szakmai életút vizsgálatakor, akár a civil szektorban vagy éppen jelen esetben a rendészet területén, gyakran a társadalmi törvényszerűségeket helytelen módon figyelmen kívül hagyva, a siker okaira vonatkozó válaszokat egyszerűen a véletlen, a szerencsefaktor vagy a kapcsolatok háza táján próbáljuk megtalálni. Sikertelen vagy nem ideálisan alakuló szakmai életutat látva magunk előtt pedig hajlamosak vagyunk a siker elmaradásának okait pusztán az egyéni szorgalom hiányában vagy a nem megfelelő életvezetésben keresni. Természetesen egyik helyzet okozata sem ennyire egyszerű képlettel írható le.

Módszertan: A siker szükséges összetevőinek egy bizonyos részét valóban a fent felsorolt tényezők összessége adja, illetve a sikertelenség jelentős része is kétségtelenül az egyén szorgalmához vezethető vissza. Amikor pedig a siker és sikertelenség igazán nehéz problémaköre egy kisebbséghez tartozó, konfliktusos életúttal veszélyeztetett és a szegénységnek vagy munkaerőpiaci sikertelenségnek egyébként is kitett személyhez kapcsolódik, a probléma összes kiváltó oka és esetleges megoldása is hatványozottan összetett társadalmi törvényszerűségekkel magyarázható.

Eredmény: A magyarországi helyzet ismeretében elmondható, hogy a rendőrség kötelékében jelenleg különböző beosztásokban dolgozó roma származású emberek esetében a sikerhez vezető út első lépcsője az emberi és szakmai önbizalom elérése és annak folyamatos növelése. A sikerhez vezető út társadalmi és szociológiai törvényszerűségek segítségével határozottan és jól körülírható. A szakmai sikertelenség elkerülése ugyanezen elvek és szabályok betartása mentén érdemben is elérhető.

Következtetés: A siker kérdése régóta központi témát képez a társadalomtudományi, gazdasági és kulturális elemzésekben. A közbeszédben és a meritokratikus narratívákban a siker gyakran az egyéni teljesítmény eredményeként jelenik meg, amely feltételezi, hogy a kiemelkedő teljesítmények arányosan nagyobb elismeréshez vezetnek. Ugyanakkor számos empirikus megfigyelés utal arra, hogy az azonos vagy hasonló teljesítmények eltérő mértékű sikerhez vezethetnek, ami a teljesítmény és a siker kapcsolatának komplexitására hívja fel a figyelmet.

Purpose: This study investigates the role of European Customs Authorities in addressing tobacco smuggling as a form of organised cross-border crime. It evaluates whether greater harmonisation of EU Customs Authorities’ law enforcement could improve effectiveness and efficiency. Tobacco smuggling is presented as a high-priority area closely associated with organised criminal networks and posing a threat to the EU’s financial interests.

Methodology: The research employs a doctrinal and policy-oriented legal analysis of EU customs legislation, including the Union Customs Code, the PIF Directive, and the ongoing EU Customs Reform proposals. A three-level analytical framework – policy, legislative, and operational – is applied to assess current levels of harmonisation and pinpoint structural gaps in enforcement across Member States. Comparative illustrations (France, Lithuania, Greece) were selected to represent distinct enforcement models and sanctioning approaches, enabling structured comparison across definitions, liability standards, and sanctioning practices.

Findings: Although customs procedures are largely harmonised, major differences persist in sanctions, investigative powers and operational practices. This fragmentation leads to enforcement inconsistencies and opportunities for “forum shopping”, undermining deterrence against organised tobacco smuggling. The proposed reforms – especially the creation of an EU Customs Authority and the partial harmonisation of administrative sanctions – mark progress, but further legislative and operational convergence is necessary.

Value: This study demonstrates that harmonised enforcement enhances customs performance and better protects the EU’s financial and security interests, thereby contributing valuable insights to the policy debate on the future of EU customs governance.

Introduction: The issue of generational differences within law enforcement organizations has become increasingly significant due to social transformation, digitalization, and changing value systems. Although existing literature extensively discusses intergenerational differences, less attention has been paid to how these differences influence conflict prevention, organizational cohesion, and leadership practices in law enforcement agencies.

Objectives: The aim of this study is to explore the organizational challenges arising from generational diversity and to present training methods, leadership techniques, and organizational solutions that may support conflict prevention and effective cooperation in law enforcement organizations.

Methodology: The study is based on qualitative literature analysis, examining national and international academic sources, leadership theories, law enforcement studies, and generational management research. The paper analyzes the role of adaptive and transformational leadership, mentoring systems, conflict management training, and organizational culture development in the functioning of law enforcement organizations.

Results: The findings indicate that generational differences within law enforcement organizations represent both potential sources of conflict and strategic organizational resources. The experience, loyalty, and hierarchical orientation of older generations complement the digital competencies and flexibility of younger generations. The results demonstrate that generational awareness training, conflict management and team cohesion programs, as well as adaptive and transformational leadership techniques, significantly improve organizational cooperation and reduce workplace conflicts. The study also highlights the importance of knowledge management, reverse mentoring, and mixed-age work teams in strengthening organizational learning and innovation.

Conclusion: The study concludes that the effective management of generational diversity is a key factor in ensuring the long-term stability and operational effectiveness of law enforcement organizations. The combined application of training programs, modern leadership techniques, and conscious organizational culture development enables generational differences to function as organizational assets rather than sources of conflict. Future research should focus on the empirical examination of generation-specific leadership models and their practical effectiveness within law enforcement institutions.

Bevezetés: A rendvédelmi szervezetekben a generációs különbségek kérdése az utóbbi évtizedekben egyre hangsúlyosabbá vált a társadalmi változások, a digitalizáció és az eltérő értékrendek következtében. A szakirodalom részletesen tárgyalja a generációk közötti eltéréseket, azonban kevesebb figyelem irányul arra, hogy ezek miként befolyásolják a konfliktusmegelőzést, a szervezeti kohéziót és a vezetői gyakorlatot a rendvédelmi szervekben.

Célkitűzések: A tanulmány célja a generációs diverzitásból eredő szervezeti kihívások feltárása, valamint azon tréningmódszerek, vezetői technikák és szervezeti megoldások bemutatása, amelyek elősegíthetik a konfliktusok megelőzését és a hatékony együttműködést a rendvédelemben.

Módszertan: A kutatás kvalitatív szakirodalom-elemzésre épül, amely hazai és nemzetközi szakirodalmak, vezetéselméleti modellek, rendvédelmi kutatások és generációmenedzsmenttel kapcsolatos tanulmányok feldolgozásával vizsgálja a generációs különbségek szervezeti hatásait. A tanulmány elemzi az adaptív és transzformációs vezetés, a mentorálás, a konfliktuskezelő tréningek, valamint a szervezetikultúra-fejlesztés szerepét a rendvédelmi szervek működésében.

Eredmények: Az elemzés rámutatott arra, hogy a generációs különbségek a rendvédelmi szervezetekben egyszerre jelentenek konfliktusforrást és stratégiai erőforrást. Az idősebb generációk tapasztalata, lojalitása és hierarchiatisztelete, valamint a fiatalabb generációk digitális kompetenciái és rugalmassága egymást kiegészítő tényezőként jelennek meg. Az eredmények szerint a generációs érzékenyítő tréningek, a konfliktuskezelő és csapatkohéziós programok, továbbá az adaptív és transzformációs vezetői technikák jelentősen hozzájárulnak a szervezeti együttműködés javításához és a konfliktusok csökkentéséhez. A kutatás hangsúlyozza továbbá a tudásmenedzsment, a fordított mentorálás és a vegyes korosztályú munkacsoportok szerepét a szervezeti tanulás és innováció erősítésében.

Konklúzió: A tanulmány megállapítja, hogy a generációs diverzitás megfelelő kezelése a rendvédelmi szervezetek hosszú távú stabilitásának és hatékony működésének egyik kulcstényezője. A tréningek, a korszerű vezetői technikák és a tudatos szervezeti kultúrafejlesztés együttes alkalmazása lehetővé teszi, hogy a generációs különbségek ne konfliktusforrásként, hanem szervezeti erőforrásként jelenjenek meg. A jövőbeni kutatások számára fontos irány lehet a generációspecifikus vezetési modellek gyakorlati hatékonyságának empirikus vizsgálata a rendvédelmi szervezetekben.

Introduction: In their 2026 study published in Magyar Rendészet, Szabó and Rémai interpreted the two-decade evolution of the European Union’s counter-terrorism policy as three distinct security paradigms. On 26 February 2026, the European Commission published the document ProtectEU: Agenda to Prevent and Counter Terrorism (European Commission 2026), which had been anticipated in the earlier study and provides an empirical opportunity to reassess both the promises of the previous strategic cycle and the question of strategic continuity.

Objectives: The study seeks to answer four main questions. How did the threat landscape evolve in 2024 compared to previous years? To what extent did the 2026 Agenda fulfil the commitments outlined in the 2024/2025 strategic framework, and which areas remained unaddressed? What level of legal binding force do the measures contained in the Agenda possess? Which structural issues remain unresolved?

Methodology: The research is based on qualitative document analysis and quantitative data analysis. The document analysis relies on a systematic comparison between COM(2026) 101 final and the 2024/2025 family of strategic documents. The quantitative section draws on data from Europol’s TE-SAT 2025 Report and the Global Terrorism Database (GTD).

Results: The 2026 Agenda represents a policy deepening of the third paradigm identified in the previous study and established in the strategic documents published in 2024/2025. The ProtectEU internal security strategy translates previously articulated ambitions into concrete legislative proposals, funding programmes, and institutional mechanisms. Three new thematic priorities can be identified: the structural management of minors’ radicalisation, the integration of artificial intelligence regulation into counter-terrorism policy, and the establishment of an EU-wide financial data access framework. At the same time, the scope of legally binding measures remains limited, while the preservation of member state sovereignty leaves the most critical implementation areas of EU counter-terrorism policy largely at the level of recommendations.

Conclusion: The 2026 Agenda does not constitute a paradigm shift. By 2026, the EU’s policy on preventing terrorism and violent extremism had entered a foundational and progressively deepening policy phase, the effectiveness of which will largely depend on the quality of implementation at the member state level.

Bevezetés: A Szabó–Rémai szerzőpáros Magyar Rendészetben megjelent, témával foglalkozó tanulmánya az Európai Unió terrorizmusellenes politikájának két évtizedes fejlődését három önálló biztonságpolitikai paradigmaként értelmezte (Szabó–Rémai 2026). Az Európai Bizottság 2026. február 26-án közzétette a tanulmányban előre jelzett ProtectEU: Agenda to Prevent and Counter Terrorism (European Commission 2026) dokumentumot, amely empirikus lehetőséget kínál az előző ciklus ígéreteinek és a stratégiai folytonosság kérdésének felülvizsgálatára.

Célkitűzések: A tanulmány négy kérdésre keresi a választ. Hogyan alakult a fenyegetési kép 2024-ben a korábbi évekhez képest? Mit teljesített a 2026-os Agenda a 2024/2025-ös keretrendszer ígéreteiből és mit nem sikerült kezelni? Milyen jogi kötelező erővel bírnak az Agenda intézkedései? Milyen strukturális kérdések maradnak megoldatlanul?

Módszertan: A kutatás kvalitatív dokumentumelemzésen és kvantitatív adatelemzésen alapul. A dokumentumelemzés a 2026-os Agenda és a 2024/2025-ös stratégiai dokumentumcsalád szisztematikus összevetésére épül. Az adatelemzési rész az Europol Terrorism Situation and Trend Report (TE-SAT) 2025-ös jelentésére és a Global Terrorism Database (GTD) adataira támaszkodik.

Eredmények: A 2026-os Agenda az előző tanulmányban jelzett 2024/2025-ben megjelent dokumentumokban felállított harmadik paradigma szakpolitikai mélyítése: a ProtectEU (Európai Belső Biztonsági Stratégia) vállalt törekvéseiből konkrét jogalkotási javaslatokat, finanszírozási programokat és intézményi mechanizmusokat bont ki. Három új tematikus hangsúly azonosítható: a kiskorúak radikalizálódásának strukturális kezelése, a mesterséges intelligencia szabályozásának terrorizmuspolitikai integrációja és az EU pénzügyi adatlekérési rendszerének megalapozása. Az Agenda kötelező erejű intézkedéseinek köre ugyanakkor szűk, és a tagállami szuverenitás fenntartása az ajánlások szintjén hagyja az uniós terrorizmuspolitika legkritikusabb végrehajtási területeit.

Konklúzió: A 2026-os Agenda nem jelent paradigmaváltást. Az EU terrorizmust és erőszakos szélsőségességet megelőző politikája 2026-ban egy megalapozó, fokozatosan mélyülő szakpolitikai fázisba lépett, amelynek eredményessége a tagállami végrehajtás minőségén múlik.

Introduction: The Hungarian police reform debate has generated substantial scholarship over three decades. Leading researchers – Géza Finszter, Ferenc Krémer, István Szikinger, László Korinek, Klára Kerezsi and László Christián – have each mapped its normative, constitutional, criminological and sociological dimensions. Yet one prior question has remained consistently unaddressed: whether the police performance measurement system produces a valid account of the organisation's own functioning at all.

Objectives: The paper aims to demonstrate that statistical self-justification, the institutional closure of the effectiveness concept, and the organisational restriction of independent research collectively block the preconditions for genuine reform.

Methods: The study combines critical document analysis with a systematic review of the Hungarian policing literature and the author's own empirical data: an attitude survey. A five-pole matrix is used to classify and compare reform debate authors by disciplinary orientation.

Results: The study identifies three structural distortion mechanisms: (1) the systematic distortion of detection statistics through the operation of the case selection mechanism; (2) the institutional marginalization of the subjective dimension of public safety from the measurement system; (3) the organizational limitation of independent law enforcement research. The views of the authors of the reform debate can be placed in a five-pole matrix, the missing pre-question of which is precisely the credibility of the statistical self-image. The career of the Good State – Good Police program has shown how the organizational immune reaction neutralizes reform proposals if the measurement system itself does not change.

Conclusion: Dismantling statistical self-justification is a constitutional, not merely methodological, task: democratic accountability requires an externally verifiable picture of police performance. The institutional freedom of independent policing research is therefore a reform prerequisite, not an optional extra. Future work should focus on integrating alternative indicators – trust indices, subjective security perceptions, victim satisfaction – into a validated mixed-methods measurement framework.

Bevezetés: A magyar rendőrségi reformvitában a hazai rendészettudomány mértékadó szerzői – Finszter Géza, Krémer Ferenc, Szikinger István, Korinek László, Kerezsi Klára és Christián László – részletesen elemezték a demokratikus rendőrség normatív, alkotmányjogi és szociológiai feltételeit. Ugyanakkor a vita egy előkérdést következetesen megkerül: nem vizsgálta, hogy a rendőrség teljesítménymérési rendszere képes-e egyáltalán érvényes képet alkotni önmaga működéséről.

Célkitűzések: A tanulmány célja annak feltárása, hogy a statisztikai önigazolás mechanizmusai, az eredményesség intézményes értelmezése és a kutatás szervezeti korlátozása miként teszik lehetetlenné a valódi reformvita kibontakozását.

Módszertan: A tanulmány kritikai dokumentumelemzésre, a hazai rendészeti szakirodalom szisztematikus feltérképezésére és a szerző saját empirikus kutatásaira épít. A mátrixmódszer a reformvita szerzőit öt diszciplináris pólus mentén rendszerezi és hasonlítja össze.

Eredmények: A tanulmány három strukturális torzítási mechanizmust azonosít: (1) a felderítési statisztikák szisztematikus torzítása az ügyszelekciós mechanizmus működése révén; (2) a közbiztonság szubjektív dimenziójának intézményes marginalizálása a mérési rendszerből; (3) a független rendészeti kutatás szervezeti korlátozása. A reformvita szerzőinek nézetei egy ötpólusú mátrixban helyezhetők el, amelynek hiányzó előkérdése éppen a statisztikai önkép hitelessége. A Jó Állam – Jó Rendőrség program karrierje megmutatta, hogy a szervezeti immunreakció miként semlegesíti a reformjavaslatokat, ha a mérési rendszer maga nem változik.

Konklúzió: A statisztikai önigazolás leleplezése nem csupán metodológiai, hanem alkotmányos tét: a demokratikus elszámoltathatóság megköveteli, hogy a rendőrség teljesítményéről érvényes, külső mérési eszközökkel verifikálható kép álljon rendelkezésre. Ebből következik, hogy a független rendészeti kutatás intézményi szabadsága reformelőfeltétel, nem jutalom. A jövőbeni kutatás feladata az alternatív teljesítménymutatók (bizalomindexek, szubjektív biztonságérzet, sértetti elégedettség) szisztematikus integrálása egy vegyes mérési keretbe.

Introduction: The use of wiretap recordings obtained through covert intelligence gathering and the use of covert devices as evidence in criminal proceedings has long been a subject of scrutiny, particularly with regard to their probative value and objectivity. At the same time, it is unclear whether the contents of transcripts prepared during the analysis of audio recordings can be used without playing the original recordings, or to what extent the reading of such transcripts in court proceedings complies with the requirements of due process.

Objectives: The aim of this study is to determine under what conditions audio recordings obtained through wiretapping conducted during covert information gathering and the use of covert devices, as well as their transcripts, may be considered objective evidence in criminal proceedings.

Methodology: The research is based on a dogmatic legal analysis grounded in the interpretation of the evidentiary system of criminal proceedings and the legal framework governing the use of covert intelligence gathering and covert devices. In this study, the author compares the specific characteristics of audio recordings and transcripts as interpreted in the context of evidence based on objective evidence, taking into account the principle of the directness of judicial evidence and the requirements for the enforcement of rule-of-law guarantees. The analysis places particular emphasis on the issue of the objectivity of evidence, as well as the examination of potential sources of distortion arising during the evidentiary process.

Results: According to the results of the study, the hearing of original audio recordings obtained through covert information gathering and the use of covert devices during a trial ensures the highest degree of objectivity in evidence, as these directly reflect the full context of the communication, including emphasis, intonation and other nonverbal elements. In contrast, transcripts are necessarily the result of an interpretive process, during which the selection, structuring, and linguistic recording of content are influenced by subjective factors. Transcripts may therefore distort the original meaning and are unable to fully convey the informational content of audio recordings. The study also highlights that the use of transcripts as exclusive or primary evidence may violate the principles of immediacy and due process.

Conclusion: The primary finding of the research is that, in criminal proceedings, only the original audio recordings obtained through covert information gathering and the use of covert devices can be considered fully valid as objective evidence. Another important finding is that transcripts can only be used in a supplementary capacity, in conjunction with the audio recordings, and cannot be endowed with independent probative value. A relevant direction for future research is to examine how technological advancements – particularly artificial intelligence-based audio processing – may influence the assessment of the evidentiary value of audio recordings and transcripts.

Introduction: The fundamental dilemma facing democratic states governed by the rule of law is striking a balance between freedom and security. In Hungary, the regulation of secret information gathering is based on a multi-pillar model: a regulatory system for law enforcement, national security, and policing. This structural fragmentation, especially in light of modern technological developments (e.g., Pegasus spyware), creates legal loopholes and a guarantee deficit, creating a gray area where the scope of the models overlaps.

Objectives: The aim of the study is to analyze the Hungarian model of covert information gathering, to explore the internal logic of the separation of the individual pillars (law enforcement, national security, and policing), and to demonstrate that the exemption of information gathering for purely national security purposes from judicial control causes a significant guarantee deficit in the effective protection of fundamental rights.

Methodology: The research is based on a dogmatic analysis of the legal norms in force, a comparative analysis of the different regulatory models (law enforcement, national security, and policing), and an examination in the context of international legal practice (in particular the case of Szabó and Vissy v. Hungary). The analysis uses the events of the Pegasus case in Hungary as a practical example to illustrate the structural shortcomings inherent in the model and the phenomenon of „forum shopping" practiced by the authorities.

Results: The research confirmed that certain pillars of Hungarian legislation are based on different legal philosophies; while the system of covert investigative techniques for law enforcement purposes is based on strong judicial control, the ministerial authorization of secret information gathering for national security purposes implements internal control by the executive branch. This structure creates a gray area (e.g., the investigation of terrorist acts) where authorities can choose the less stringent national security procedure, thereby circumventing judicial oversight. The investigation conducted by the National Authority for Data Protection and Freedom of Information in the Pegasus case confirmed the practical existence of this phenomenon.

Conclusion: The primary lesson of the study is that Hungary's multi-layered model of secret information gathering creates a systemic guarantee deficit that jeopardizes the protection of fundamental rights. Consequently, an important policy recommendation is to extend independent judicial control to information gathering for national security purposes and to strengthen parliamentary oversight. In the future, it may be worth examining whether the introduction of the proposed judicial control mechanism, based on foreign models, requires an amendment to the constitution or whether it can be achieved within the framework of lower-level amendments.

Bevezetés: A demokratikus jogállamok alapvető dilemmája a szabadság és a biztonság egyensúlyának megteremtése. Magyarországon a titkos információgyűjtés szabályozása többpilléres modellen alapul: a bűnüldözési, a nemzetbiztonsági, valamint a rendészeti célú szabályozási rendszeren. Ez a strukturális tagoltság, különösen a modern technológiai fejlődés (például Pegasus kémszoftver) fényében, joghézagokat és garanciális deficitet teremt, létrehozva egy szürkezónát, ahol a modellek hatásköre összemosódik.

Célkitűzések: A tanulmány célja a titkos információgyűjtés magyar modelljének elemzése, az egyes pillérek (bűnüldözési, nemzetbiztonsági és rendészeti) elválasztása belső logikájának feltárása. Továbbá a tanulmány igazolni kívánja, hogy a tisztán nemzetbiztonsági célú információgyűjtés bírói kontroll alóli kivétele jelentős garanciális deficitet okoz a hatékony alapjogvédelemben.

Módszertan: A kutatás a hatályos jogi normák dogmatikai elemzésére, a különböző szabályozási modellek (bűnüldözési, nemzetbiztonsági és rendészeti) összehasonlító analízisére, valamint a nemzetközi joggyakorlat (különösen a Szabó és Vissy kontra Magyarország ügy) kontextusában való vizsgálatára épül. Az elemzés gyakorlati példaként használja a Pegasus-ügy magyarországi eseményeit a modellben rejlő strukturális hiányosságoknak és a hatóságok által alkalmazott forum shopping jelenségének bemutatására.

Eredmények: A kutatás igazolta, hogy a magyar szabályozás egyes pillérei eltérő jogfilozófián alapulnak; míg a bűnüldözési célú leplezett eszközök rendszere erős bírói kontrollra épül, addig a nemzetbiztonsági célú titkos információgyűjtés miniszteri engedélyezése a végrehajtó hatalom belső kontrollját valósítja meg. Ez a struktúra szürkezónát teremt (például terrorcselekmények felderítése), ahol a hatóságok a kevésbé szigorú, nemzetbiztonsági eljárást választhatják, ezzel kikerülve a bírói felügyeletet. A Nemzeti Adatvédelmi és Információszabadság Hatóság Pegasus-ügyben folytatott vizsgálata megerősítette e jelenség gyakorlati létezését.

Konklúzió: A tanulmány elsődleges tanulsága, hogy a magyar titkos információgyűjtés többrétű modellje rendszerszintű garanciális deficitet teremt, amely veszélyezteti az alapvető jogok védelmét. Ebből következően fontos szakpolitikai javaslat a független bírói kontroll kiterjesztése a nemzetbiztonsági célú információgyűjtésre is, valamint a parlamenti felügyelet megerősítése. A jövőben érdemes lehet vizsgálni, hogy a javasolt, külföldi mintákból merített bírói kontrollmechanizmus bevezetése igényel-e alaptörvény-módosítást, vagy megoldható-e alacsonyabb szintű módosítások keretein belül.

Introduction: The development of smart cities and the integration of information and communication technologies are fundamentally transforming the functioning of the modern urban environment. At the same time, the cyber-physical systems emerging as a result of digitalization are creating new types of security challenges that arise in the fields of law enforcement, transportation safety, and cybersecurity. Examining these processes is particularly relevant given the rapid proliferation of electric vehicles.

Objective: The objective of this review is to provide a comprehensive, critical analysis of Ákos Orbók’s study titled “Cybersecurity in the Smart City,” focusing on the challenges posed by urbanization and digitalization processes in the fields of criminology and traffic safety. The study also aims to synthesize the theoretical findings of the reviewed work with the results of empirical research examining the cybersecurity of electric mobility devices, as well as with the latest international and domestic literature.

Methodology: The work is based on a methodology of descriptive and analytical literature review. To validate and contextualize the theoretical claims, the review incorporates data from the author’s previous research examining technology acceptance and firmware vulnerabilities in e-scooters, supplementing it with insights from international cybersecurity paradigms and the domestic “smart policing” paradigm.

Findings: Orbók’s study provides an excellent theoretical foundation for understanding the vulnerabilities of smart cities, highlighting that IT security gaps in cyber-physical systems generate immediate physical risks. This theoretical framework is fully corroborated by practical micromobility tests and the international literature, as cost-effective but low-security IoT devices can be easily manipulated, creating new types of traffic safety and cybersecurity threats.

Bevezetés: Az okos városok fejlődése, valamint az információs és kommunikációs technológiák integrációja alapvetően alakítja át a modern városi környezet működését. A digitalizáció következtében létrejövő kiberfizikai rendszerek ugyanakkor új típusú biztonsági kihívásokat teremtenek, amelyek a rendészettudomány, a közlekedésbiztonság és a kiberbiztonság területén egyaránt jelentkeznek. E folyamatok vizsgálata különösen aktuális az elektromobilitási járművek gyors terjedése miatt.

Cél: A recenzió célja Orbók Ákos Az okos város kiberbiztonsága című tanulmányának átfogó, kritikai elemzése, fókuszálva az urbanizációs és digitalizációs folyamatok rendészettudományi és közlekedésbiztonsági kihívásaira. A tanulmány célja továbbá, hogy a recenzált mű elméleti megállapításait a szerző az elektromobilitási eszközök kiberbiztonságát vizsgáló empirikus kutatások eredményeivel, valamint a legújabb nemzetközi és hazai szakirodalommal szintetizálja.

Módszertan: A munka a leíró és elemző szakirodalom-feldolgozás módszertanára épül. Az elméleti állítások validálása és kontextualizálása érdekében a recenzió beépíti a szerző korábbi, a technológiaelfogadási hajlandóságot és az e-rollerek firmware sérülékenységét vizsgáló kutatásainak adatait, kiegészítve azt a nemzetközi kiberbiztonsági és a hazai „okosrendőrség” paradigmák tapasztalataival.

Megállapítások: Orbók tanulmánya kiváló elméleti alapot nyújt az okosvárosok sérülékenységének megértéséhez, rámutatva, hogy a kiberfizikai rendszerekben az IT-biztonság hiányosságai azonnali fizikai kockázatot generálnak. Ezt az elméleti keretet a gyakorlati mikromobilitási tesztek és a nemzetközi szakirodalom maradéktalanul igazolják, ugyanis a költséghatékony, de alacsony biztonsági szintű IoT-eszközök könnyedén manipulálhatók, ami új típusú közlekedésrendészeti és kiberbiztonsági fenyegetéseket teremt.

Érték: A recenzió hozzájárul a rendészettudományi diskurzushoz azáltal, hogy hidat képez az okosvárosok elméleti kiberbiztonsági koncepciói és a mindennapi közlekedésrendészeti gyakorlat között, rávilágítva a felhasználói biztonságtudatosság elengedhetetlen szerepére az elektromobilitás korában.
