The international community in the past decades has been struggling for raising the right to environment officially into the body of human rights, either on its own or in constituents – such as the right to water. Although environmental protection is the basis and condition of everything – also of human rights –, deeply based in Christianity and also part of the messages of the Church for decades. It has also been inevitable that human rights and environment – the Creation – should come together in the same teaching. Next, I shall follow this road from the beginning, together with its consequences, with a special focus on the teaching of the Catholic Church.

Évtizedek óta küszködik a nemzetközi közösség azzal, hogy hivatalosan is az emberi jogok közé emelje a környezethez való jogot akár önmagában, akár összetevőiben – különösen ilyen lehetne a vízhez való jog. A környezet védelme pedig mindennek – az ember jogoknak is – forrása és feltétele, a kereszténységben is a kezdetektől mélyen gyökerezik, és ugyancsak évtizedek óta része az egyházak üzeneteinek. Szükségszerű volt, hogy az emberi jogok és a környezet – a Teremtés – találkozzanak ugyanezen tanításokban. Ennek útját a kezdetektől, valamint következményeit tekintem át a következőkben, kiemelt figyelemmel a Katolikus Egyház tanítására.

At the drafting time of the Universal Declaration of Human Rights, it seemed neither possible, nor necessary to establish a philosophical anthropological definition of the human person whose rights were proclaimed by the Declaration. Nowadays, this is, however, inevitable because neither human legal personality, nor the most fundamental and real human rights could be proclaimed, established, or enforced without it. For nowadays, when the intellectual milieu is governed by prevalent libertarian and value relativist ideas, these rights are, mostly due to the lack of their conceptual basis, often turned against the person himself, his right to legal personality, life and human dignity. The Catholic natural law tradition has, on the other hand, always proved to be an effective aid in this process, when, through his rights, the
human person is to be protected in ever new bioethical situations.

Az Emberi jogok egyetemes nyilatkozata megfogalmazása időszakában nem tűnt lehetségesnek, de szükségesnek sem azon emberi személy filozófiai antropológiai meghatározása, akinek jogait a dokumentum kinyilvánította. Manapság azonban ez elkerülhetetlen, mert sem az emberi jogalanyiság, sem a legalapvetőbb valódi emberi jogok nem jelenthetők ki, nem alapozhatók meg és nem is védhetők anélkül. Manapság ugyanis e jogokat sokszor, az uralkodó libertariánus és értékrelativista szellemi közegben, éppen a fogalmi megalapozás hiányában maga az ember ellen, annak jogalanyiságához, élethez és méltóságához való joga ellen fordítják. A katolikus természetjogi hagyomány nagy segítséget nyújtott mindig is e megalapozásban, miközben már újabb és újabb bioetikai helyzetekben kell védeni az emberi személyt legalapvetőbb jogain keresztül.

This essay aims to introduce the proposal of Pierre Manent, the French Catholic philosopher, to reconstruct natural law, mainly in his book on Natural Law and Human Rights, originally published in 2017. Manent’s book is also interesting as a sharp criticism of the discourse of natural human rights. He starts out from the obvious contrast between the human rights discourse in a European and a non-European context, which reveals its internal logical contradiction. This is followed by a historical reconstruction of the early modern rise of the human rights discourse, as it took place between Machiavelli and Hobbes, resulting in the decline of the reference to natural law. This synchronic and diachronic analysis is followed by the substance of Manent’s own proposal. First, he introduces his view of politics, based on the dialectic of command and obedience, in the life of the active political agent. This is followed by the least convincing part of his book, a thin concept of natural law, narrowed down to the three motivations of human action: the pleasant, the useful and the honest (together with the just and the noble). Yet this is followed by a highly relevant, Aristotelian–Thomistic account of reflective human action, based on practical
wisdom and the common good. Manent proposes to lead the human rights discourse back to its proper place in contemporary public discussions.

A dolgozat arra vállalkozik, hogy Pierre Manent rangidős francia katolikus filozófusnak a természetjog visszaállítására vonatkozó javaslatát mutassa be, főként A természetjog és az emberi jogok című 2017-eskönyve alapján. Manent könyve egyben a természetes emberi jogok diskurzusának éles kritikája is. Kiindulópontja az e diskurzusra jellemző belső ellentmondásosság, amely az Európán belüli, illetve a földrészen kívüli helyzetre vonatkozó emberjogi érvelések közötti különbség miatt keletkezik. A szinkrón helyzetelemzést eszmetörténeti rekonstrukció követi, a Machiavellitől Hobbesig vezető fejlődési ív bemutatása, amely elvezetett a természetjog háttérbe szorításához és az emberi jogok beszédmódjának felerősödéséhez. E szinkrón és diakrón helyzetelemzés után tárja elénk a filozófus saját felfogásának alapjait. Kiindulópontja, hogy a politika világa a parancs és az engedelmesség logikájára épül, s a cselekvő embert helyezi középpontjába. E politikaképet egy olyan szűkített természetjogi koncepció követi Manent gondolatmenetében, amely az emberi  ermészetet meghatározó háromféle motiváció (a kellemes, a hasznos és a tisztességes – kiegészülve az igazságossal és a nemessel) alapján megítélhetőnek tartja a politikai rezsimeket. Míg e szűkített koncepciót a dolgozat kétkedéssel fogadja, annál meggyőzőbbnek tartja azt a manent-iérvelést, amely az arisztoteliánus–tomista gyakorlati bölcsességet és a közjóra hivatkozó érvelést kívánja visszahozni a kortárs diskurzusba, saját helyére szorítva vissza az emberjogi beszédmód politikai felhasználását.

The expression of religious belief is simultaneously protected by the right to freedom of religion and the right to free expression. Furthermore, freedom of expression also includes the right to remain silent; i.e. no one can be compelled to express their opinion or the views of others. The question has also been raised before the courts of the United Kingdom and the United States as to whether making a cake constitutes speech and whether the baker may refuse it on the grounds of freedom of religion. The problem that arises is complex and, in addition to freedom of religion and expression, it also raises issues related to ensuring equal treatment for all and even to protecting human dignity. This paper will review these cases and the decisions taken and analyse them from the points of view of freedom of expression, non-discrimination, protection of human dignity and freedom of religion.

A vallási meggyőződés kinyilvánítását egyszerre védi a vallás- és a szólásszabadság joga. A szólásszabadságnak ugyanakkor része a hallgatáshoz való jog is, azaz senki nem kényszeríthető a véleménye vagy más véleményének kimondására. A közelmúltban az Egyesült Királyság és az Egyesült Államok bíróságai előtt is felmerült a kérdés, hogy vajon a tortakészítés beszédnek minősül-e, illetve hogy a cukrász megtagadhatja-e a felé irányuló megrendelés teljesítését vallásszabadságára hivatkozva. A felmerült probléma komplex, és a vallás-, valamint a szólásszabadságon túl az egyenlő bánásmód biztosításának, sőt az emberi méltóság védelmének kérdéseit is feszegeti. A tanulmány ezen ügyeket és a megszületett döntéseket tekinti át, és elemezi a szólásszabadság, a diszkriminációtilalom, az emberi méltóság védelme, a vallásszabadság szempontjából.

This paper does not deal with the notion of constitutional resistance (ius resistendi), an ancient notion in Hungary, England or Poland, instead it focuses on the emergence of the notion of disobedience as not a political or moral opportunity, but a moral duty. The post-war political and moral imagination has emphasised – alongside with the notion of natural law – the moral (even legal) duty of disobedience in case of unjust law or order. Although in the political thinking the mainstream problem was how to cope with the rebel as an eternal danger for political community, the history of Christian moral thinking, arranged around the idea of conscience, produced the opposing notion of the duty of disobedience. In the Scholastic thinking, the problem of fallible conscience led to a debate between St. Thomas Aquinas and St. Bonaventura in which the first one argued that conscience should follow in any case, even against authority, while the second wrote that in case of conflict between one’s conscience and an authority, conscience should be put aside because of its
potential fallibility. The modern notion of the moral duty of disobedience is rooted in Aquinas’s argument in the debate.

A tanulmány nem az alkotmányos ellenállás (ius resistendi) magyar, angol vagy lengyel ősi fogalmával foglalkozik, hanem az engedetlenség – ami nem politikai vagy erkölcsi lehetőség, hanem kötelesség – képzetének kialakulásával. A háború utáni politikai és erkölcsi gondolkodás hangsúlyozta, a természet törvény fogalmával együtt, az engedetlenség, parancsmegtagadás erkölcsi, sőt jogi kötelességét az igazságtalan törvény vagy parancs esetében. Noha a politikai gondolkodásban hagyományosan a fő probléma az volt, hogyan kerüljék el a lázadást, amely a politikai közösséget örökké fenyegeti, a lelkiismeret fogalma köré épülő keresztény erkölcsi gondolkodás története ezzel ellentétes fogalmat eredményezett, az engedetlenség kötelességének a fogalmát. A skolasztikában a tévedékeny lelkiismeret problémája vezetett a Szent Tamás és Szent Bonaventura közti vitához, amelyben az első amellett érvelt, hogy a lelkiismeretet minden esetben követni kell, akár az autoritással szemben is, míg a második azt írta, hogy a lelkiismeret és az autoritás ütközése esetén a lelkiismeretet félre kell tenni, mivel tévedhet. Az engedetlenség erkölcsi kötelességének képzete nyilvánvalóan Szent Tamásnak az ebben a vitában kifejtett érveléséből ered.

The German Federal Constitutional Court (GFCC) is certainly one of the most respected institutions in Germany and beyond. The court and its decisions enjoy a high level of public support among German citizens, which implicates that the political elite has almost always complied with the tenor of the court’s decisions. Nevertheless, political leaders felt sometimes encouraged to evade the command of the GFCC. One of these rare occasions was the so-called Kruzifix decision from 1995 when Bavarian politicians have not only openly criticised the court but called upon resistance against the court decision during a public demonstration in Munich with more than 20,000 participants. The present study will disclose the causes that led to one of the greatest crises of the FCC since 1945, and focus on the question why the position of the FCC has been (temporarily) destabilised by the issue of the crucifix in the classroom and the question of freedom of religion.

A Német Szövetségi Alkotmánybíróság (Bundesverfassungsgericht) kétségkívül az egyik legnagyobb tekintéllyel bíró testület Németországban, sőt szinte egész Európában. Döntései és maga az intézmény is széles körű támogatottságot élveznek a német állampolgárok körében. Ez a tekintély és a magas bizalmi index együttesen oda vezetett, hogy döntéseivel a politikai elit tagjai csak nagyon ritkán mertek szembeszegülni. Ezen ritka alkalmak egyike 1995-ben a bajor feszületügyben meghozott döntésük volt, amikor bajor politikusok nemcsak a döntést és az alkotmánybíróság intézményét kritizálták nyíltan, hanem több tízezres tömegtüntetésen a bírósági döntés figyelmen kívül hagyására szólítottak fel. Jelen tanulmány tanulmány annak kíván utánajárni, hogy milyen okok vezettek a német alkotmánybíróság II. világháború utáni legnagyobb kríziséhez, hogy miért pont a vallásszabadság alapvető emberi joga és az iskolai feszületek kérdése destabilizálta (átmenetileg) a német alkotmánybíróság helyzetét.

The study overviews the basic international human rights instruments on marriage and the family. By grouping their provisions according to their substantive content, it seeks to draw a conclusion as to the nature of the protection of the two social phenomena under international law. It then reviews the extent to which marriage and family can be seen as essential components of European culture. Starting from the conception of marriage in Old Testament, the Jewish and Roman imperial law, it presents the contemporary universal  and domestic ecclesiastical conception after reviewing the rules of the Catholic Church, which conveys these values. As a result, the study concludes that the European culture is based on the conception of marriage and family presented. The rejection of these values would be either impossible or would create another culture.

A tanulmány áttekinti a házasságra és a családra vonatkozó legfontosabb nemzetközi emberi jogi dokumentumokat. Ezek rendelkezéseit tárgyuk szerint csoportosítva kísérel meg következtetést levonni a két társadalmi jelenség nemzetközi jogi védelmének jellegére. Ezt követően áttekinti, hogy a házasság és a család mennyire tekinthető az európai kultúra lényeges összetevőjének. Az ószövetségi zsidó és a római birodalmi jog házasságfelfogásából kiindulva, az ezeket az értékeket továbbvivő Katolikus Egyház szabályainak áttekintése után bemutatja a kortárs egyetemes és hazai egyházi felfogást. Mindennek eredményeként vonja le azt a következtetést, hogy az európai kultúra a bemutatott házasság- és családfelfogásra épül. Ennek elvetése vagy lehetetlen, vagy egy másik kultúra létrehozását jelentené.
