Abstract
One of the conditions for the personnel supplementation of national defence organizations in a special legal order is that persons planned for military service on the basis of conscription meet the conditions specified in the legislation. One of the conditions is that the person concerned does not hold a post that is in retention. The lecture presents the current system, situation and role of the order in the military supplement of defence organizations. It examines the various pieces of legislation for the military administration and highlights shortcomings and inaccuracies and their consequences.
