The study aims to highlight the controversial human rights situation of the so-called “non-citizens” residing in the Baltic successor states of the USSR that since have become members of the EU through the prism of fundamental rights and non-discrimination, and the detrimental impacts inherent to the lack of effective nationality with special regard to the inability to fully enjoy the rights and opportunities associated with EU citizenship. It stresses the utmost importance for the European Union to promote the human rights of non-citizens living in EU territory in the Baltic region, especially in Latvia and Estonia, where the vast majority of non-citizens belonging to the Russian-speaking minorities reside.

We can say that digitalisation, integration into the digital world is no longer an option but a compulsion. It is indispensable and not worth experimenting with. Although digitalisation is a fashionable and frequently used expression, it is not inconceivable to clarify what is meant by it. The concept covers the operation of transforming a computer-read, encoded formwork that has already appeared on a different medium (text, image, sound). Digitized materials are most commonly accessed on a variety of media through the Internet. The greatest achievement of transparency, as far as possible, is also an important and  indispensable part of the political, economic and social processes of the 21st century. In this paper, I examine the points of connection between the two concepts and the possibilities and frameworks provided by regulation, primarily in the domestic relation, but with an international perspective.

For the analysis of contemporary discourse of tolerance and pluralism it is indispensable to examine the historical, political and philosophical context where it first came to be evaluated. Protestantism created the historical situation where it became a main political relevance to protect the individual value choices and to let the people choose freely. The freedom of conscience and thought evolved naturally from the religious tolerance. In my paper I present the classical thoughts of liberal thinkers of the 19th century on this issue, because they have defined the framework in which we can elaborate our thoughts on pluralism.

Studies indicate that the use of the minority mother tongue in dealings with administrative authorities plays a key role in preserving it and endows it with a higher status than its teaching in school. The use of the minority language on the local and regional level is the best indicator of whether minority language rights are implemented in a country. The lack of public administration personnel who speak minority languages and official forms in minority languages pose great difficulties in implementing language rights. The guarantee of the right to be educated in the mother tongue and use it in public helps ensure the cultural reproduction and survival of the community.

Article 51 of the Charter of Fundamental Rights of the European Union lays down that the institutions and bodies of the European Union shall “respect the rights, observe the principles and promote the application thereof”. Competition proceedings have their own special characteristic, but such procedures also have to be consistent with the protection of the fundamental rights. This article demonstrates through some cases of the Court of Justice of the European Union that adequate and effective remedies ensure that competition proceedings are conducted with full respect of the fundamental rights.

In the Coman case,1 the Court was asked by the Constitutional Court of Romania whether a non-EU citizen same-sex spouse of a Romanian national should be granted, by virtue of the provisions of the EU law on freedom of residence for EU citizens, a permanent right to stay in Romania, where the conclusion and the recognition of same-sex marriages are prohibited by the
national law.

By the judgment of 5 June 2018, the Court ruled that the term “spouse” within the meaning of the provisions of EU law on freedom of residence for EU citizens, which entitle the family members of an EU citizen exercising the right to freely move within the EU to stay with this citizen, includes spouses of the same sex.

In this regard, the Court set out that, although the Member States have the freedom whether or not to authorise marriages between persons of the same sex, they may not obstruct the freedom of residence of an EU citizen by refusing to grant his
same-sex spouse, regardless of this latter’s nationality, a derived right of residence in their territory.

A Coman-ügyben a román alkotmánybíróság azt kérdezte az Európai Bíróságtól, hogy egy az unión belüli szabad mozgáshoz és tartózkodáshoz való jogával élt román állampolgár azonos nemű és nem uniós polgár házastársa az uniós jog alapján annak ellenére jogosult-e a házastársával való együttélés céljából a Romániában való állandó tartózkodásra, hogy a román jog nem engedélyezi az azonos nemű személyek számára a házasságkötést, valamint nem teszi lehetővé a más államokban ilyen személyek által kötött házasság elismerését.
2018. június 5-én meghozott ítéletében a bíróság úgy határozott, hogy az uniós jognak az uniós polgárok szabad mozgáshoz és tartózkodáshoz való jogáról szóló rendelkezései szerint, amelyek lehetővé teszik az e jogával élő uniós polgár családtagjai számára, hogy azok kövessék az uniós polgárt az annak új tartózkodási helye szerinti tagállamba is (majd onnan adott esetben vissza a származási tagállamba), a házastárs fogalma magában foglalja az azonos nemű házastársat is.
E tekintetben a bíróság megállapította, hogy noha a tagállamok szabadságot élveznek a tekintetben, hogy engedélyezik-e, vagy sem az azonos nemű személyek közötti házasságkötést, nem akadályozhatják valamely uniós polgár szabad tartózkodáshoz való jogát azzal, hogy nem uniós állam állampolgárságával rendelkező, azonos nemű házastársától megtagadják a területükön
való tartózkodáshoz való származékos jogot.

This article intends to present some of the most important developments in the period between 16 March and 15 June 2018 concerning the case law of the European Court of Human Rights, such as cases against Hungary pertaining to issues of international child abduction and freedom of assembly, as well as other cases concerning the notion of “matters referred to the Court” and the validity of a derogation under Article 15. It would further report on an important step in the reform process concerning the Court – notably, the impending entry into force of Protocol No. 16 to the Convention.

Az alábbi írás az Emberi Jogok Európai Bíróságának (a továbbiakban: EJEB) ítélkezési gyakorlatát érintő, a 2018. március 16-a és június 15-e közötti időszakban bekövetkezett néhány fontosabb fejleményét kívánja számba venni. Kitér azonban egy, az Emberi Jogok Európai Egyezményével (a továbbiakban: egyezmény) kapcsolatos, de nem szorosan véve az ítélkezési gyakorlatot érintő eseményre, nevezetesen a 16. Kiegészítő Jegyzőkönyv küszöbön álló hatálybalépésére is. Ami az elmúlt időszak magyar vonatkozású ügyeit illeti, ezek részben gyermekek jogellenes külföldre vitelével, részben pedig a gyülekezési szabadság gyakorlásával voltak kapcsolatosak. A külföldi vonatkozású határozatok közül a cikk a terjedelmi korlátok miatt csak két elvi jelentőségű döntést ismertet: az egyik „az EJEB elé terjesztett” és általa vizsgálható kérelem fogalmát járta körül, a másik pedig elsősorban az egyezmény alkalmazásának felfüggesztésével kapcsolatos feltételek szempontjából érdemel említést.

The Constitutional Court (CC) made 122 decisions between 1 February and 30 April 2018. From these 122 decisions, 23 examined the petitions on the merits. In 2 cases the CC found the ordinary court’s – namely, the Curia’s – decisions unconstitutional. The CC made 6 decisions in judicial initiatives for norm control in concrete cases, and 116 in constitutional
complaints. Most of the constitutional complaints submitted to the CC (89 cases) were against judicial decisions. 9 constitutional complaints were related to the 2018 Hungarian parliamentary election.

In Decision 3027/2018. (II. 6.) AB, the CC found the Curia’s interlocutory judgment unconstitutional, because this judgement was made in a reopened case, where the Curia failed to repeat the oral hearing part of the procedure, moreover, the new interlocutory judgment was remarkably identical with the previous one. Because of these reasons, the CC concluded that the Curia’s procedure did not meet the requirements of an impartial judicial process.

In Decision 3093/2018. (III. 26.) AB, the CC reviewed a ruling of the Curia about the suspension of the immunity of an independent candidate. The CC found that immunity is not a personal right of the candidate, rather it is created to protect the National Assembly itself. In case of candidates (not MPs) the National Election Office decides upon the suspension of the immunity, in the name of the National Assembly. The CC stated that this decision is not a judicial or other official decision, therefore the lack of legal remedy is not unconstitutional and the decision-making process is in line with the right to vote.

In another election-related decision – Decision 3130/2018. (IV. 19.) AB – the CC reviewed the regulation of election posters. In this case, the Curia ruled that the use of certain posters of the Fidesz–MPSz political party is unlawful because their imprints are hardly visible and they can be easily confused with the Hungarian Government’s public service announcements. The CC disagreed with the Curia’s interpretation and stated that the Act on Electoral Procedure does not contain any restrictions about the posters’ imprints, thus any election poster can be used in the election campaign period, as long as it is clear whose interests they serve.

In Decision 3/2018. (IV. 20.) AB, the CC declared an omission on the part of the law-maker that resulted in violating the Fundamental Law, because the Parliament failed to regulate the obligation of the Hungarian National Bank’s foundations to publicize information about financial supports given to certain private individuals from public funds.

Az Alkotmánybíróság testületei 2018. február 1. és április 30. között 122 döntést hoztak. E döntések közül az Alkotmánybíróság 6-ot bírói kezdeményezésre, 116-ot pedig alkotmányjogi panasz alapján fogadott el. Az alkotmányjogi panaszok közül 2 az Alkotmánybíróságról szóló 2011. évi CLI. törvény (a továbbiakban: Abtv.) 26. § (1) bekezdése szerinti, alaptörvény-ellenes jogszabály alkalmazása miatti panasz, 6 az Abtv. 26. § (2) bekezdése szerinti, úgynevezett kivételes, „direkt” panasz, 89 az Abtv. 27. §-aszerinti, alaptörvény-ellenes bírói döntés miatti panasz, további 19 pedig vegyes – egyszerre alaptörvény-ellenes jogszabály alkalmazása és alaptörvény-ellenes bírói döntés miatti – panasz volt. Az alkotmányjogi panaszok közül 9 az általános országgyűlési választásokhoz kapcsolódó, a választási eljárásról szóló 2013. évi XXXVI. törvényben (a továbbiakban: Ve.) 233. §-aalapján előterjesztett, és az ott írt szabályok szerint soron kívül elbírált indítvány volt.
Az összesen 122 döntésből 23 volt határozat, 99 pedig végzés. A határozatok közül 2 rendelkezett megsemmisítésről, e határozatok a Kúria támadott ítéleteit semmisítették meg. A megsemmisítést tartalmazó határozatokon kívül 1 további határozat már nem hatályos törvényi rendelkezések alaptörvény-ellenességét mondta ki. 3 határozat mulasztással előidézett alaptörvény-ellenesség fennállását állapította meg. Alkotmányos követelményt 1 határozatban fogalmazott meg az Alkotmánybíróság. 16 határozat tartalmazott elutasítást. Azok közül a határozatok közül, amelyek vagy megsemmisítésről, vagy mulasztásról, vagy alaptörvény-ellenesség megállapításáról, illetve alkotmányos követelmény megállapításáról rendelkeztek (összesen 6 határozat), 1-hez – az alkotmányos követelményt kimondó határozathoz – nem kapcsolódott sem párhuzamos indokolás, sem különvélemény; ugyanakkor valamennyi mulasztást megállapító döntéshez kapcsolódott különvélemény, a Kúria döntését megsemmisítő egyik határozathoz pedig 5 párhuzamos indokolást fűztek.
A 99 végzésből – amelyekből 8-at fogadtak el a teljes ülésen, a többit az Alkotmánybíróság tanácsai hozták meg – 94 végzés az indítványok visszautasításáról szólt, 3 végzés az eljárás megszüntetéséről, 2 végzés pedig az eljárás felfüggesztéséről. Az alkotmányjogi panaszok visszautasításának leggyakrabban előforduló indokaiként továbbra is változatlanul a következők említhetők: az Abtv. 29. §-a szerinti kritériumnak (bírói döntést érdemben befolyásoló alaptörvény-ellenesség, vagy alapvető alkotmányjogi jelentőségű kérdés megléte) meg nem felelés; a releváns alkotmányjogi érvelés, vagyis az alaptörvény-ellenesség megindokolásának hiánya; valamint az, hogy az indítványozó nem Alaptörvényben biztosított jog sérelmére (hanem esetleg az Alaptörvény valamely más rendelkezésének a megsértésére) hivatkozott az indítványban. A vizsgált időszakban ezenkívül több visszautasító végzés is született amiatt, mert az indítványozó az Abtv. 27. §-a szerinti alkotmányjogi panaszában nem az ügy érdemében hozott döntést, vagy a bírósági eljárást befejező döntést támadta meg.
Indítványozók szerinti megoszlásban a vizsgált időszakban 6 döntés bírói kezdeményezés alapján, 116 döntés pedig  alkotmányjogi panaszosok (akik között indítványozóként feltűnt gazdasági társaság, alapítvány, politikai párt, rendőrség, büntetés-végrehajtási intézet, óvoda, társasház, szakszervezet, sőt a magyar állam is) indítványai, illetve beadványai alapján.
A befejezett ügyek túlnyomó részét a vizsgált időszakban is az alaptörvény-ellenesnek tartott bírói döntésekkel szemben előterjesztett alkotmányjogi panaszok tették ki. Az indítványok sikerességének aránya (a megsemmisítésről, mulasztásról, alaptörvény-ellenesség megállapításáról, valamint alkotmányos követelmény kimondásáról rendelkező 6 határozattal számolva) a meghozott döntések száma alapján 5,7% volt.
