Leaving the EU has potential effects on trade, investments, productivity, income, labour market and on public finances. The EU membership has significantly enhanced the UK’s economic prosperity mainly through three main mechanisms: trade, foreign investment and the financial sector. Missing precedents make it difficult to anticipate the economic consequences of the Brexit. Facing these problems three approaches are possible: working with studies which focus on accession experience, i.e. ex post revealing of integrations effects in order to assess the potential effects of disintegration; simulation of Brexit with quantitative equilibrium models; or restricted forms of ex ante projections on the trade effects of the EU membership.

The starting point of these analyses is the development of trade under the terms of disintegration. The impact analysis should be based on its static and dynamic effects and on other impact factors. Analyses suggest that the Brexit will result in a significant decrease of the GDP, which may reach the level of 10% if we take into account the dynamic long term effects as well. The negative effect depends on the level of the disintegration: in case of a soft Brexit, more moderate effects can be expected.

Az EU elhagyásának potenciális következményei lényeges mértékben érintik a kereskedelmet, a beruházásokat, a termelékenységet, a jövedelmeket, a munkapiacot és a közpénzügyeket. Az EU-tagság – három fő hatásmechanizmusa: a kereskedelem, a külföldi beruházás és a pénzügyi szektor révén – lényeges mértékben hozzájárult az Egyesült Királyság gazdasági prosperitásához. A Brexit gazdasági következményeinek előrejelzését megnehezíti a hasonló precedensek hiánya. E kihívásokkal szembesülve a témakör kutatása során három megközelítés kínálkozik a Brexit hatásainak becslésére: a csatlakozási tapasztalatok hatásait feldolgozó tanulmányok, azaz az integráció hatásainak utólagos (ex post) feltárása a dezintegráció lehetséges következményeinek felmérése érdekében; a Brexit hatásainak (ex ante) szimulációja számszerűsíthető egyensúlyi modellek alkalmazása révén; illetve redukált formájú (ex ante) becslés az EU-tagság kereskedelemre gyakorolt hatásairól.

E vizsgálatok kiindulópontja a kereskedelem alakulása a dezintegráció feltételei között. Annak statikus és dinamikus hatásai, illetve a további hatótényezők bekapcsolása révén végezhető el a hatáselemzés. Az elvégzett elemzések szerint a Brexit jelentős, a dinamikus hatások figyelembe vételével hosszabb távon mintegy 10%-os GDP-veszteséget okozhat. E negatív hatás a dezintegráció mértékével párhuzamos: „puha” Brexit esetében mérsékeltebb veszteség körvonalazható.

The European Social Model defined as a collective notion — or the social and emloyment policy which gives its fundament — plays an important part in the functioning of the Eupean Union. According to the hypothesis of the study, the technological, structural and labour-market processes starting with the financial and economic resurrection from the collapse in 2008 call for urgent need of the rethinking and also the maintainance of the concept of ‘Social Europe’. The study is based on the analysis of relevant works and policy papers as well as that of official documents. It concludes that the creation and contents of the social model is strongly connected to the issues defining the development of the European integration and the preservation of its values. The analysis is given a special focus by the recent concepts of the future of the EU and the publication of the first draft of the multiannual financial framework after 2020 expected to come out in May 2018. It defines and declares the social policy in the EU and more widely it provides the role and influence of the European social model.

Az EU működésében fontos szerepet tölt be a gyűjtőfogalomként értelmezett európai szociális modell, illetve az alapját képező foglalkoztatás- és szociálpolitika. A tanulmány kiindulópontja szerint a 2008-aspénzügyi és gazdasági válságból való kilábalással egy időben elindult strukturális, technológiai és munkaerőpiaci folyamatok kibontakozása szükségessé teszi a „szociális Európa” koncepciójának fenntartását és egyben újragondolását. A tanulmány a témában megjelent releváns szakirodalom és elsődleges szakanyagok, hivatalos dokumentumok elemzésére támaszkodik. Következtetése szerint az európai szociális modell alakulása és értékeinek megőrzése szorosan összekapcsolódik az európai integráció fejlődését meghatározó tényezőkkel. Az elemzésnek külön aktualitást ad az EU jövőjével kapcsolatos elképzelések alakulása, valamint 2018 májusára várható a 2020 utáni többéves pénzügyi keret első változatának megjelenése, ami jelentős mértékben meghatározza az uniós szociálpolitika, átfogóbban pedig az európai szociális modell szerepét és hatóerejét.

Through the comparative analysis of the ECHR Grand Chamber Judgment reached upon the appeal of the Hungarian Government in Fábián v. Hungary (app. no. 78117/13) and CJEU judgments C-258/14. and. C-64/16., this paper examines that in the aftermath of the economic and financial crisis what kind of external fundamental rights barriers should be observed by those states that intend to adopt measures restoring budgetary balance but have a limited legal room for maneuver based on scarce financial means and, in parallel, on the obligations and measures prescribed in the EU legal system. This is especially interesting in cases where – in addition to the pension – these measures prohibit the joint payment of wages and pensions for people working in the public sector.

Following the summary introduction of the general legal background, i.e. firstly the legal frames of financial crisis management, and secondly the legal means for the protection of individual rights, this analysis will examine the general conclusions of the judicial decisions at hand, then turns to the detailed analysis of each of the decisions upon underlining important differences and similarities significant from the standpoint of a comparative methodology.

While there are substantial discrepancies regarding procedure and legal basis between the procedural rules of the respective courts and between the legal systems underlying the judgments, by reason of the similarity of the facts of these cases (i.e. limiting the accumulation of pensions and wages earned in the public sector with an eye on restoring budgetary balance) it is worthwhile to summarize what are the legal grounds in the European courts that qualify such state measures as lawful, which are attacked based on similar legal grounds in terms of the field of law concerned (protection of fundamental rights) and of the rights protected (property and equal treatment).

All in all, the results of the analysis show that albeit we see clashes between the legal arguments regarding the principle of equal treatment especially in the Strasbourg jurisprudence, the public policy (i.e. reduction of budgetary deficit), on which the measures are based is a sufficient basis for the limitation of fundamental rights, if the necessity (subject to a restricted scrutiny in front of these courts) and proportionality (primarily regarding their temporary nature) of these measures can be determined.

A tanulmány az Emberi Jogok Európai Bíróságának a 78117/13. sz. panasz alapján, a Fábián kontra Magyarország ügyben a magyar kormány fellebbezését követően hozott nagykamarai ítélete, valamint az Európai Unió Bíróságának a C-258/14. sz. és a C-64/16. sz. ügyekben hozott ítéleteinek összehasonlító elemzésén keresztül vizsgálja, hogy a gazdasági és pénzügyi válságot követő szűk pénzügyi és ezzel párhuzamosan az uniós jogrendszerben előírt kötelezettségvállalások és rendelkezések alapján szűkülő jogi mozgásterükben a költségvetési egyensúly visszaállítását célzó intézkedéseket elfogadó tagállamoknak, nevezetesen amikor ezek az intézkedések a nyugdíj mellett a közszférában munkát vállaló személyek nyugdíjának és munkabérének együttes folyósítását tiltják, milyen külső alapjogi korlátoknak kell egyúttal megfelelniük.

Az elemzés az általános jogi háttér, így egyrészt a pénzügyi válságkezelés jogi kereteinek, másrészt az egyes személyek érdekét védő jogi eszközöknek, az összefoglaló bemutatását követően, vizsgálja a bírói döntések általános következtetéseit, majd az összehasonlító módszertan szempontjából fontos különbözőségeik és hasonlóságaik kiemelését követően tér rá az egyes ítéletek részletes elemzésére.

Mind az eljárás, mind a jogalapok kapcsán részben a bíróságok előtti eljárásrend, részben az ítéletek alapjául szolgáló jogrendek közötti különbségek miatt lényeges eltérések mutatkoznak. A tényállások hasonlósága, tudniillik a költségvetési egyensúly visszaállítása érdekében a nyugdíjak és a közszférában megkeresett munkabérek halmozásának korlátozása folytán érdemes összegezni, hogy a nem csupán a jogterület – nevezetesen az alapjogvédelem –, hanem a védett jogok – a tulajdonhoz való jog védelme és az egyenlő bánásmód elve – tekintetében hasonló jogalapokon támadott állami intézkedések milyen indokok alapján minősülnek jogszerűnek az európai bíróságok előtt.

Összességében az elemzés eredménye azt mutatja, hogy bár különösen a strasbourgi ítélkezési gyakorlatban az egyenlő bánásmód elve kapcsán jogi érvek valós ütközését látjuk, az intézkedések alapjául szolgáló közérdek, tudniillik a költségvetési hiány csökkentése, megfelelő alapja az alapjogi korlátozásnak. Előbbi azonban korlátozottan vizsgálható a bíróságok előtt, utóbbi kapcsán elsősorban az intézkedések időszakos jellegét emelik ki a bírói fórumok.
