This essay argues that the doctrine of human rights is an essentially political, and not a moral or philosophical issue. After introducing the concept of political doctrine, I focus on classic authors from Locke to Burke, from Vitoria to Paine, from Mill to Stephen, to show how the doctrine was formed within specific political contexts. I also argue that although in the 19th century, the Catholic Church was widely regarded as the fiercest opponent of the freedom of conscience, surely a fundamental human right, the theological tradition of the Church was essentially ambivalent. She was supportive of the natural freedom of conscience, but for the well-known theological reason of the corruption of human nature, she was wary of the freedom of conscience being enshrined as a political right, thereby 
reinforcing the political nature of the doctrine. Further, it will also be shown that this  ‘right’ has been firmly connected to specific (mostly ecclesiastical) institutional forms (universities, legal processes), and that during the robust democratisation of the Western world, individuals have become the ‘institutional forms’ of these rights, hence the application of political concepts such as sovereignty, self-determination, self-governing to individuals. The massive political power of human rights defence movements and organisations confirms the political nature of their underlying ideological commitments. Thus, notwithstanding the moral and philosophical efforts to found and defend human rights, both their historical origins and their contemporary role make them an essentially political doctrine.

Ebben a tanulmányban amellett érvelek, hogy az emberi jogok doktrínája lényegileg politikai, nem pedig erkölcsi vagy filozófiai természetű. Miután bevezetem a politikai doktrína fogalmát, néhány klasszikus szerzőt idézek, Locke-tól Burke-ig, Vitoriától Paine-ig, Milltől Stephenig, hogy bemutassam, miként alakult ki a doktrína a maga sajátos politikai kontextusában. Amellett is érvelek, hogy bár a 19. században a Katolikus Egyházat  tartották a lelkiismereti szabadság (értelemszerűen az egyik legalapvetőbb jog) legádázabb ellenfelének, az Egyház teológiai hagyománya valójában ambivalens volt. A lelkiismereti szabadságot természetes adottságként kezelte, de az emberi természet megrontottságának jól ismert teológiai argumentuma miatt bizalmatlanul tekintett ennek az adottságnak a jogként való körülbástyázására. Ezzel azonban a doktrína politikai jellegét erősítette meg. Azt is bemutatom, hogy ezt a ’jogot’ a kezdetektől fogva bizonyos (többnyire Egyházon belüli) intézmények (egyetemek, jogi eljárások) formalizálták. A nyugati világ masszív demokratizálódása során ezeknek a jogoknak az egyének váltak az intézményi formáivá. Ezt igazolja, hogy az egyének leírása során számos politikai fogalmat használunk (szuverenitás, önrendelkezés, önkormányzás). Az emberjogi, jogvédő mozgalmak és szervezetek jelentős politikai ereje a mögöttük fölépített ideológiai elkötelezettségek politikai jellegét szintén megerősíti. Így az emberi jogok megalapozására és megvédésére tett erkölcsi és filozófiai erőfeszítések ellenére ezek a  jogok a maguk politikai eredete és mai szerepe miatt politikai doktrínának nevezhetők.

The aim of this work is to prove that the system of human rights is not far from religious beliefs, furthermore, they belong together. The basis of human rights comes from the freedom that is given by God. Human dignity is embedded in all rights. The Christian idea of freedom supports human rights, which are naturally inseparable from the individuals. Through the investigation of privacy and rights relating to personality, dealing with the problem of equality, we can conclude, that human rights must cover some social rights
as well, based on the Christian approach.

A tanulmány bizonyítani igyekszik, hogy a vallási meggyőződéssel élő embert nem távolítani kell az emberi jogok rendszerétől, hanem épp ellenkezőleg, közelíteni kell felé. Az emberi jogok a Teremtő adta emberi szabadságból erednek, minden jog mélyén megtalálható az emberi méltóság. Az emberi jogok az embertől elválaszthatatlan olyan természetes és elidegeníthetetlen jogok, amelyeknek tápláléka a keresztény szabadságeszme is. A tanulmány foglalkozik a személyiségvédelemmel, érinti a magánszféra védelmét, az egyenlőség problémáját, valamint arra a megállapításra jut, hogy az emberi jogok alatt bizonyos szociális jogokat is érteni kell a keresztény szellemű megközelítés alapján.

Comparing Christian liberty and classic liberalism is a popular issue of public debates. The  paper considers only one part of the topic; it analyses Christian liberty from the viewpoint of the Bible and constitutional liberty in the aspect of classical liberal doctrines. The paper cannot and will not present either the liberal or the biblical standpoint of human nature in its entirety. It only aims at comparing the source, the content and the target of liberty.

A keresztény szabadság és liberális szabadság szembeállítása a közéleti viták egy népszerű  témaköre. The basic question of the study is on what grounds a Christian can sue? Even if it were his/her fundamental rights protected by the Constitution, would it be better, if he/she mildly gave up his/her claim? This essay seeks to address this problem with the help of the evening examination of conscience. It draws the contours of an “emotional”, intent-oriented constitutionalism, based on human salvation and focusing on vices, instead of the mainstream, individualistic, consequence-oriented and rational constitutionalism.

A tanulmány alapkérdése, hogy egy keresztény ember milyen alapon perelhet. Még ha saját, alkotmányban védett alapjogáról van szó, nem lenne helyesebb, ha szelíden lemondana igényéről? A tanulmány az esti lelkiismeret-vizsgálat eszközeivel keres választ erre a kérdésre. Az uralkodó, emberi méltóságra alapozott, individuális, következményorientált, emberi jogokban megnyilvánuló és „racionális” alkotmányosság helyett felvázolja egy „érzelmi” alkotmányosság alapvonalait, amely az emberi üdvösségre alapoz, személyes, szándékorientált, és tárgyául a bűnöket teszi meg.

The study assumes how pre-Christian people met Christian religion, then follows up the causes effecting the weakening of Christianity, that is to say the renaissance of “God of Nature” (deism) in philosophy and arts. The Christian freedom remained a constructive power in the era of enlightenment; however, the first secularisation attempts that had  started by that time disrupted the organic tissues of the Western culture for the last two centuries. Sciences came to a standstill since it neither could prove the origin of life nor could answer the meaning of life. Has the instinctive demand of human communities for transcendental responses disappeared? Has the Westerner got burned out and reached the point where it searches the community building beliefs and meanings again in God? Will the experiment of the secularised society fail in the next decades? Will the secular states loosing religious roots lose their viability, too? What characterises the synthesis of the 21st century arising from Christianity’s thesis and secularisation’s antithesis? What are the signs that Western communities are going to find the modern or postmodern form of Christian religion? Our conclusion is that neither the ideal form of secularised  freedom, nor political ideologies, nor science itself could have become a new community building and integrating power. Religious tradition as a community building spirit and 
a common archetype cannot be replaced for long. After a desperate two hundred 
year-long ‘period of quest’, the revitalisation of Christian religion could respond to the  disruption of Western communities. Nowadays, conservative politics, including policies for national upswing and the strengthening of the national religious life, should be seen within this historical flow. Conservatism recognises that Christian community teachings and the Christian God principle with messages in the 20th century could bring about a resurgence of the common beliefs in ‘eternal truth’ and the common search for lost Paradise of Western humans.

A tanulmány felidézi a keresztény vallás előtti ember találkozását a keresztény vallás tanításaival, majd nyomon követi a kereszténység gyengülésének okait, azaz a „természet Istenének” (deizmus) reneszánszát a filozófiában és a művészetekben. A keresztény szabadság a felvilágosodás korában még alkotóerő, azonban a vallással szembeni szekularizáció kísérlete is elindul, és két évszázadon át napjainkig bomlasztja a nyugati kultúra organikus szöveteit. A tudomány holtpontra jutott, mert továbbra sincs bizonyítéka az élet eredetére, és nincs válasza az emberi élet „céljára”. Kihalt-e az emberi közösség ösztönös igénye a transzcendens válaszokra? Kiégett és megérett-e a nyugati ember arra, hogy újra Istenben keresse a közösséget építő hitet és célokat? Elbukik-e a következő évtizedekben a szekularizált társadalom kísérlete? Elvesztik-e  életképességüket a semleges társadalmak? Milyen lehet a kereszténység tézise és a szekularizáció antitézise nyomán születő 21. századi „szintézis”? Milyen jelek utalnak arra,  hogy a nyugati kultúra közösségei megtalálják a keresztény vallás modern vagy posztmodern formáját? Következtetésünk, hogy a szekularizált szabadságeszmény és a politikai ideológiák sem tudtak, és a tudomány sem tudott közösségépítő és közösségmegtartó erővé válni. A vallási hagyomány mint közösségépítő erő és közösségi  őskép tartósan nem helyettesíthető. Kétszáz év kétségbeesett útkeresés után a keresztény vallás újjászületése lehet a kiút a nyugati ember válságából. Napjainkban a konzervatív politika, benne a nemzetpolitika és a nemzeti valláspolitika erősödése is ebben a történelmi áramlásban értelmezhető. A konzervativizmus felismeri, hogy a jézusi tanítások, a keresztény istenelv 21. századi üzenetekkel újra felébresztheti az „örök igazságok” hitét, az elveszett Paradicsom keresését, és újra nagy közösségi erővé válhat.

How can we reconcile the command of Law and freedom of man? The ancient answer was based on the classical concept of Nature, the Christian on the free will of man (hence the concept of Christian freedom), whereas the modern on the political rights of man. The ancient concept of freedom was derived from man’s accommodation to the laws of nature, the Christian freedom emphasised the fight against sin, and the modern concepts voice the safeguards of the human rights ensured by a commonwealth treaty. Man’s rationality is confined and limited according to the ancient and Christian understanding, whereas limitless by the modern conception. The previous ones regard Law as absolute, the latter, however, tendentiously relativises the scope and strength of Law, and tends to use it in the plural, i.e. laws. Modernity, discarded God first, then Natural Laws from the conception of freedom, and subjected to constant political debates, thus relativising Law as such (c.f. French Revolution), and blurred the dividing line between what is public and what is private. The understanding of freedom placed the individual in the focus. This essay is on the relativisation of Law, the conceptual comparison of ancient and modern
freedom, and the modern tendency towards totalising politics.

Hogyan egyeztethető össze a törvény parancsa a szabadsággal? Az antik válasz a természet klasszikus fogalmából indult ki, a keresztény a szabad akaratból,
a modern az individuum politikai jogaiból. Az antik szabadság a természeti törvényekhez való alkalmazkodást tanította, a keresztény szabadság a bűnnel való harcot, a modern szabadság pedig a szerződés révén konstruált állam által nyújtott garanciákat hangsúlyozza. Az antik és a keresztény szemléletben az emberi racionalitás véges, korlátozott, a modernben ezzel szemben korlátlan. Az előbbiek a törvényt abszolútnak tekintik, míg az utóbbi az emberi racionalitás által folyamatosan relativizált törvényfogalmat használ. A modern felfogás előbb Istent, majd a természet fogalmát is kiiktatta a szabadság értelmezéséből, kizárólag politikai alku tárgyává tette, ily módon relativizálta a törvényt, a természetet, a közélet és a magánélet közti határvonalat. Középpontban az individuum felfedezése áll. A jelen írás a törvény relativizálásáról, a régi és az új szabadság összehasonlításáról, illetve a modern totalizáló politikafelfogásról szól.

The paper investigates the notion of human rights as an object of ‘faith’, ‘religion’ or ‘secular religion’. While the extraordinary vagueness of all such claims and the terms contained therein makes it impossible to draw any analogy with religion in general, it remains true that several features of the theory of human rights show similarities to those of certain traditions usually called religious, most importantly Christianity.

This essay focuses on the notion of Christian liberty, examining it from the perspective of several fields of science. It concentrates mainly on the preparation
of a legal and also of a theological notion by revealing and cataloguing the main possible elements those notions might consist of. We offer a traditional
and also a more dynamic, process-like version related to both aspects. Firstly, the new legal notion of Christian liberty is based on a sociological basis that
refers not only to the legal norms / legal decisions but also to the practices of different authorities beyond those legal sources. Secondly, the new theological notion of Christian liberty is shown by referring to the stages of the development of a human being’s character. Moreover, this essay properly demonstrates that the results of different sciences may mutually influence each other.

A tanulmány a keresztény szabadság fogalmát kívánja körüljárni, több tudományterület nézőpontjából is megvizsgálva azt. Szűkebb célja jogi és teológiai
megalapozású munkafogalmak előállítása, azok főbb elemeinek feltárása, katalogizálása. Mindkét vonatkozásban ismertetjük a hagyományosnak tekinthető „statikus” megközelítéseket, valamint – s ez adja a valódi újdonságot – a dinamikusabb, folyamatszerűségük révén életközelibb fogalmakat előkészítő felvetéseket, új elemeket is. A jogi fogalom meghatározása során ez egy jogszociológiai megközelítést eredményez, amely a ténylegesen jogként érvényesülő gyakorlatok elmélyültebb vizsgálatára törekszik a különféle jogforrások mechanikus elemzése, kommentálása helyett. A teológiai fogalom
esetében pedig a hagyományos szekvenciák ellenében a szabadság dinamikus fogalmának megragadására egy kiteljesedő emberi karakter fejlődési fázisai
révén kerül sor. A tanulmány jól mutatja a különféle tudományterületek
eredményeinek egymásra gyakorolt hatását, és – szándékai szerint – utat
nyit a további kutatásoknak is.

It has been the Biblical vision on the human person that has determined the Western world. Man and woman created upon the image of God, endowed
with free will have a unique dignity. Traditionally, the rationale of the state is to serve the common good; however, the content of this doctrine has been
changing over history. Nowadays we regard human rights and especially religious freedom as inherent parts of the common good. The first part of the
paper provides for an insight into the evolution of the doctrine of the Catholic Church on the freedom of religion. The second part of the paper outlines the
chances of a culture originating from Christianity in an age when Christian faith is diminishing in society.

A Biblia emberképe vitathatatlanul meghatározza a nyugati világ szemléletét, akár az emberi személy méltóságára, akár a társadalom alakítására tekintünk. Az Isten által a maga képmására teremtett férfi és nő, a szabad akarattal felruházott ember egyedülálló méltósággal bír. Hagyományos megfogalmazással
az állam rendeltetése a közjó szolgálata, e fogalom tartalma ugyanakkor történelmi koronként némileg változó. Ma az emberi jogokat, és köztük is kitüntetetten a vallás szabadságát, a közjó fogalmába tartozónak tekintjük, ez azonban az elmúlt évtizedek változásai nyomán alakult ekként. A jelen tanulmány egyrészt a Katolikus Egyház vallásszabadsággal kapcsolatos reflexiójának néhány szempontját mutatja be, másrészt arra keres választ, hogy milyen esélyei vannak a keresztény gyökerekből táplálkozó kultúrának akkor, ha a keresztény hit megfogyatkozik egy társadalomban.
