Porn and Platforms: Regulatory Attempts of Online Pornographic Content before and after the DSA

Abstract
In our study, we examined platforms distributing pornographic content from a media law perspective, in particular from a platform regulation perspective. Our research aims at reviewing three main sub-themes: the history of (porn) platform regulation, the impact of the EU Digital Services Act (DSA) on pornographic content and platforms, and the regulatory and practical challenges and dilemmas for porn websites. In this paper, we have examined the extent to which the DSA, as a “pioneer” regulatory solution, changes existing regulatory initiatives and how existing legal gaps could be addressed by legal and non-legal solutions. The study is methodologically based on a comprehensive interdisciplinary literature review and legal analysis. As a result, it is concluded that, although DSA is a significant step forward in guaranteeing the safe use of platforms, it is far from sufficient to adequately address porn platforms. While transparency and fundamental rights mechanisms apply to porn platforms, we question whether they are effective and efficient. In this article, we propose to involve civil society and experts in the regulation of porn platforms, to harmonise national regulatory environments and to encourage global cooperation.
