Cartel-Question Regarding the Syndicate Agreement

Abstract

In the fields between public and private laws, like in competition law and procurement law, there have been many cases in the past few years, where the collaboration or agreement of companies affected fair competition. The main purpose of this paper is to demonstrate the collaborations and agreements of companies, which have a big impact on fair competition, regarding the syndicate agreement, like a unique cooperation agreement. In this context first I would like to examine the legal literature, the statutory instruments in force and the resolutions of The Office of Economic Competition. Then I would like to synthesize my statements in this paper. I conclude that cartels cannot be eliminated entirely. We can make them illegal, but we cannot exclude the possibility they are established in secret.
