Comparative Analysis of the Hungarian and French Regulation of the General Rules of Administrative Procedures with a Special Regard on the Remedy Procedures
Abstract
The objective of this paper includes a comparative analysis of the current codes of the administrative procedures in Hungary and in France. The actuality of this paper is that in France, the first Administrative Procedure Act called “Code des relations entre le public et l’administration” came into force on 1 January 2016. With this Code, France joined the group of countries that have a lex generalis regarding administrative procedures. In Hungary, also a completely new Code of the General Rules of Administrative Proceedings came into force on 1 January 2018. The paper presents the structures of these administrative procedure codes and comprehensively examines them. Finally, the paper focuses on the novelties of the Hungarian and French regulation of legal remedy system following administrative decisions.
