Inhuman and Degrading Treatment Against Mentally Ill Prisoners, as a Special Category of Prisoners. Part 1: International and National Documents

Abstract

Due to the subject’s complexity, the paper primarily presents the relevant international documents in connection with the protection of mentally ill prisoners. Furthermore, it is important to define inhuman and degrading treatment and to review international documents which declare the prohibition of such treatment. Therefore, the paper introduces the relevant documents and briefly explains the situation of the mentally ill prison population before studying the case-law of the European Court of Human Rights.
