This study aims to analyse the role of the border between Ireland and Northern Ireland in the Brexit negotiations. The present writer starts with the assumption that this is the most complicated issue in the whole Brexit process. The study first makes an attempt to delineate the historical background, with special emphasis on the partition of the island in 1921. The second part is concerned with the proposals of the European Union concerning the border; these basically aim at the realization of the so-called “backstop” solution which presupposes that Northern Ireland should remain in the customs union (and partly also in the single market) while the UK is leaving both of these institutions. The study emphasizes that London rejects this on principle because this would necessarily entail the economic separation of Northern Ireland.

A tanulmány a meglehetősen bonyolult Brexit-folyamat legnehezebb kérdését, Észak-Írország és az Ír Köztársaság határának az ügyét kívánja közelebbről is megvizsgálni. Az írás először az (észak)ír határ jelentőségének történelmi hátterét vázolja fel, különös tekintettel az Ír-sziget kettéosztására és a brit–ír kapcsolatok alakulására, majd az Európai Uniónak az északír–ír határra vonatkozó elvárásaival és brüsszeli indítványokra adott londoni válaszokkal foglalkozik. A kulcskérdés a „backstop” fogalma, amely az EU megközelítésében azt a követelést foglalja magában, hogy a határ „megkeményedésének” elkerülése érdekében Észak-Írország maradjon a vámunióban és részben az egységes piacban, miközben Nagy-Britannia mindkettőből kilép. A tanulmány hangsúlyozza, hogy London ezt elfogadhatatlannak tartja.

The latest financial and economic crisis and the differentiated recovery process stressed the need for a deeper economic integration. Scenarios that are on the agenda as for the differentiated integration have different priority areas. The basic aim is to make the Economic and Monetary Union complete (EMU 2.0); however, there are still uncertainties. The study provides a wider analysis of the topic with special attention on the unsustainability of the current EMU, the competition of the Banking Union, Euro area risk sharing, fiscal union and on the Euro area common budget.

At the inception of the European integration, the solidarity necessary to achieve the defined objectives was given, and the project was strongly supported by society. However, at that time, circumstances were substantially different: fewer member states and more moderate internal differences combined with dynamic economic growth. In our days, the future path of European integration should be determined jointly by a large number of member states that are exhibiting considerable and, in part, growing differences, and are more or less successful in finding the sources of post-crisis growth. In the course of searching for the solution, it is worth carrying out an in-depth analysis of intra-EU competitiveness differences and their potential impact on integration. At the same time, ensuring solidarity is an intellectual challenge. Differentiated integration appears to be the most feasible way; nevertheless, out of its large variety, the one that puts a halt to or, in the optimal case, reverts intra-EU divergence, has to be selected in a smart way, or else the EU may head towards disintegration with which no member state, and thus neither the EU, can win.

Az európai integráció kezdetén a kitűzött célok eléréséhez szükséges szolidaritás adott volt, és erős társadalmi támogatást élvezett. Abban az időben azonban a maitól lényegesen eltérőek voltak a körülmények: kevesebb tagállam, kisebb belső különbségek, dinamikus gazdasági növekedés. Napjainkban nagyszámú tagállamnak kellene kijelölnie az integráció jövőbeli útját, amelyek immáron számottevő és – részben – egyre növekvő különbségeket mutatnak fel, a válság utáni növekedés új forrásait pedig több-kevesebb sikerrel találják meg. A megoldás keresése közben célszerű mélyebben megismernünk az EU-n belüli versenyképességbeli különbségeket, és azok kihatását az integrációra. A szolidaritás biztosítása intellektuális kihívást is jelent. A differenciált integráció látszik a leginkább járható útnak – ám okosan kell kiválasztani sok lehetséges változatából azt, amely megállítja, sőt, optimális esetben megfordítja az EU-n belüli divergens folyamatokat, nem pedig a dezintegráció felé taszítja az EU-t, amivel egyetlen tagállam – és így Európa sem – nyerhet.

Non-reciprocal trade agreements provided by the developed countries are important factors in the relations of North-South trade, and this was early recognized by the European continent. Europe has traditionally played a major role in Africa with political, economic and cultural influence, and after the decolonization process, the European presence has remained significant on the African continent. The present paper analyses the impact of trade agreements between the European Union, the East African Community and the Southern African Development Community using international literature review and statistical data. In total, the Lomé Conventions have not achieved their objectives of poverty reduction and development, however they have increased the importance of European markets. The trade stimulative impact of the Trade, Development and Cooperation Agreement with South Africa was temporary. However, in the framework of the Economic Partnership Agreements both the East African Community and the Southern African Development Community represent an independent region, which can spur the trade between the European Union and the Eastern and Southern African regions.

A fejlett országok által biztosított egyoldalú kereskedelmi egyezmények, az észak–dél kereskedelmi kapcsolatok egyik fontos tényezőjét képezik, amit az európai kontinens korán felismert. Európa gyarmatbirodalmi múltja komoly hatást gyakorolt az afrikai országokra, és a gyarmatok függetlenedése után is jelentős maradt az európai jelenlét az afrikai kontinensen. A tanulmány az Európai Unió által a Kelet-afrikai Közösségnek és Dél-afrikai Fejlesztési Közösségnek nyújtott kereskedelmi kedvezmények hatását mutatja be a nemzetközi szakirodalom áttekintése és statisztikai adatok segítségével. Az eredmények szerint a Loméi Egyezmények nem érték el a szegénységcsökkentő és fejlesztési céljukat, viszont növelték az európai piacok relatív fontosságát. A Dél-afrikai Köztársasággal kötött TDCA egyezmény kereskedelemélénkítő hatása is csak átmenetinek bizonyult. A Gazdasági Partnerségi Egyezmények keretében viszont a Kelet-afrikai Közösség és a Dél-afrikai Fejlesztési Közösség is külön régiót képvisel a partnerek között, amely új lendületet adhat az Európai Unió és a kelet- és dél-afrikai régió közötti kereskedelmi kapcsolatoknak.

The introduction in the 1990s of the principle of extended producer responsibility was a major environmental policy innovation of the European waste legislation. In line with this principle certain member states and, subsequently, the EU itself started to delegate waste management responsibilities from the holder of the waste to the manufacturer (or the first distributor) of the original product. While the efficiency of extended producer responsibility as a policy tool is questionable, it was nonetheless elevated among the core instruments of national waste action by the revision of EU waste law between 2016 and 2018. Consequently, the financial and organisational burdens of waste management can now be fully placed on the shoulders of producers. Yet, the new legislation does not create an entirely clear regulatory environment for producers or authorities alike. This study aims to clarify some of the critical distinctions under the new system of extended producer responsibility.

Az Európai Unió kiemelt jelentőségű környezetpolitikai újítása volt az 1990-esévekben az úgynevezett kiterjesztett gyártói felelősség elvének megjelenése a közösségi hulladékjogban. Ezen alapelvnek megfelelően az egyes tagállamok, majd később az EU is bizonyos hulladékról való gondoskodás felelősségét a hulladék birtokosától a termék eredeti gyártójához (vagy első forgalmazójához) telepítette. Bár a kiterjesztett gyártói felelősség mint szakpolitikai eszköz hatékonysága erősen megkérdőjelezhető, az uniós hulladékjog 2016–2018 közötti felülvizsgálata mégis a tagállami eszköztár kiemelt instrumentumává emelte. Ennek megfelelően a hulladékgazdálkodás pénzügyi és logisztikai terhei gyakorlatilag teljes mértékben a gyártókra terhelhetők. Az új szabályozás azonban korántsem teremt egyértelmű helyzetet sem a gyártók, sem a nemzeti jogalkotók és hatóságok számára. Jelen tanulmány a kiterjesztett gyártói felelősség új rendszere kritikus elhatárolási kérdéseinek tisztázására tesz kísérletet.

Starting out from essential state functions anchored in Article 4(2) of the Treaty on the European Union to protect constitutional identity, this paper will endeavour to examine a judgment delivered by the Court of Justice of the European Union in June 2018. Within the context of free movement, the Coman case raises questions, also with reference to the prohibition of discrimination, to the CJEU on the application of EU law in terms of the notions of family life, family and family member under Directive 2004/38/EC. Beyond the standpoint of the Court in this case, we shall also overview those public law frames within the EU law that exist in relation to the concept of family (rules of the Charter of Fundamental Rights and of other relevant directives), and the pertinent provisions of Romanian Member State law will also be addressed, including the relevant most recent decision of the Romanian Constitutional Court delivered in 2018, not in relation to the case discussed herein.

Az alábbi tanulmány – kiindulva az alkotmányos identitás védelmére az Európai Unióról szóló Szerződés 4. § (2) bekezdése által a lényegi állami funkcióknak rögzített védelemből – az Európai Unió Bírósága 2018. júniusában meghozott egyik ítéletének vizsgálatát végzi el. A Coman-ügy a szabad mozgás szabadságának kontextusában, a hátrányos megkülönböztetés tilalmára is utalással vet fel kérdéseket az EUB számára a családi élet, a család, valamint a családtag 2004/38/EK irányelvbe foglalt fogalma kapcsán az EU-jog alkalmazása tekintetében. Az ügyben a Bíróság álláspontján túl áttekintjük az EU-bana családfogalom kapcsán létező közjogi kereteket (Alapjogi Charta szabályai, egyéb irányelvi rendelkezések), valamint a román tagállami jog vonatkozó rendelkezéseit is górcső alá vesszük, beleértve a román Alkotmánybíróságnak a tárgyra tartozó, de nem ezen ügy vonatkozásában 2018-banmeghozott legfrissebb határozatának értékelését is.
