Absztrakt
A tanulmány a regionális vagy kisebbségi nyelvek európai chartájának 9. cikkével foglalkozik, amely a bíróságok előtti kisebbségi nyelvhasználat terén nyújt különböző fokozatú kötelezettségek közüli választást a részes államok számára. Amellett, hogy a cikk tartalmát, a részes államok ratifikációját, illetve az egyezmény végrehajtása felett őrködő Szakértői Bizottság hozzáállását vizsgálja, főként arra keres választ, hogy milyen tényezők akadályozzák a választott kötelezettségek gyakorlati végrehajtását, és melyek bátortalanítják el a kisebbségi nyelvek beszélőit attól, hogy a bíróságok előtt éljenek jogaikkal.
