Current Interpretation Questions of Compensation for Placement Conditions Violating Fundamental Rights

Abstract
This paper attempts to identify and clarify the diverse interpretation practice of the regional courts in cases when convicted people initiated indemnification because of the violation of their fundamental rights concerning housing circumstances. In spite of the fact that the law governing the previously mentioned right for indemnification entered into force on 1 January 2017, there are still numerous uncertainty concerning its application, which goes against the rights of the law seeking citizens. It is the Constitutional Court which deals with these uncertainties and questions and gives guidance how the penal enforcement act should be interpreted. It is important to note, however, that the Constitutional Court observes these cases from the perspective of fundamental rights. On the basis of court judgments and related decisions of the Constitutional Court, this paper deals with the following questions: claim submission deadlines; complain-issue obligation; transitional provisions.
