Justice and the Use of Minority Languages:

Article 9 of the European Charter for Regional or Minority Languages

Abstract

The study deals with Article 9 of the European Charter on Regional or Minority Rights, which offers States Parties a choice of obligations of varying degrees of difficulty with regard to the provision of minority language use before the courts. In addition to examining the content of the article, the ratification of States Parties and the attitude of the Committee of Experts, which oversees the implementation of the Convention, it focuses on the factors that hinder the practical implementation of the chosen obligations and discourage minority language speakers from exercising their rights before the courts.
