A nemzetközi pénzügyi intézmények felelőssége az emberi jogok megsértéséért

Absztrakt
A nemzetközi pénzügyi intézmények többsége olyan nemzetközi szervezet, amelynek kifejezett célja a gazdasági fejlődés erősítése és a szegénység csökkentésének a támogatása. A tevékenységeik közvetlenül vagy közvetve segítik a kormányokat az emberi jogi kötelezettségeik teljesítésében is. A nemzetközi pénzügyi intézmények közötti jelentős különbségek és a rájuk vonatkozó gyakorlat korlátozottsága ellenére széles körben elismert, hogy kötik őket a nemzetközi jog általános elvei és a nemzetközi szokásjog, beleértve bizonyos emberi jogi normákat is. Az őket megillető kiváltságok és mentességek alapján azonban mentességet élveznek az államok bíróságainak a joghatósága alól. Jelen tanulmány a nemzetközi pénzügyi intézmények felelősségének a határaival foglalkozik, a támogatott projektjeik által érintett személyek vonatkozásában. Miközben ezekre az intézményekre hagyományosan úgy tekintettek, hogy nincsenek emberi jogi kötelezettségeik, az elmúlt években jelentős változások történtek korlátozott immunitásuk elismerése terén.
