Application Experiences of the Administrative Recess Regulation

Abstract

This study reviews the regulatory framework of the legal institution of the administrative recess to date, as well as the practical experiences arising from its application in recent years. Based on these findings, it formulates de lege ferenda proposals for the legislator in order to ensure that both the previously enacted provisions concerning the administrative recess and the new statutory rules involving the suspension of administrative authority operations are applied in a clear and predictable way for clients. As virtually no academic literature is available on the subject of the administrative recess, the conclusions of the study are based on the statutory and subordinate regulatory framework, as well as on the practical experience gained from its application to date.
