The Subjects of the Public Service Legal Relationship with Specific Regard to the Legal Status of the Workforce

Abstract

The purpose of the paper is to explore the main regulatory dilemmas and trends related to the status and the position of the public workforce, i.e. to examine the main circumstances determining and shaping the legal status of the staff of the public service.
The paper attempts to identify and localize the personnel of public service from a theoretical perspective: firstly, in line with the classical theories; secondly, in light of the prevailing international trends; thirdly, with regards to the statistics; fourthly, from the perspective of the structure of the Hungarian legal system and, fifthly, by pointing out the possible views on the “human-face” of public service regulation.
Although the paper accepts the increasingly fragmented nature of staffing (being in line with international trends), it attempts to raise some theoretical regulatory options for a somewhat more uniform arrangement of the status of civil service.
