Freedom of Information and Re-use of Public Sector Information: Differences and Common Points

Abstract

The subject matter of the Freedom of Information (FOI) Law and the Law on the Re-use of Public Sector Information (PSI) is the same in Hungary. Thus, it is worth analysing the two regulatory regimes from each other’s point of view. It is also clear, that the main purposes of the FOI and PSI regulation is different, so the existence of different provisions are justified. In this essay, the FOI and the PSI regimes are analysed, showing first the constitutional background and then studying step by step the data request procedure. As a consequence, it seems that common policy, common structure, but different detailed provisions are needed in order to properly regulate these legal institutions.
