A hallgatói jogviszony természetéről
Abstract
Almost 4 percent of the adult Hungarian population has a special legal relationship (student status) with a higher education institution. This relationship provides a legal framework for education establishing the rights of students and higher education institutions alike while also describing their obligations. By examining the characteristics of the student’s legal status, the study aims to find its place between the domains of civil law and public law. The answer is important for the future development of the regulation as well as for the management of an occasional student-institution dispute. In order to form an overall picture, the study gives a short historical overview of the changes of the student status, presents the main characteristics of the relevant civil and public laws, while also referring to the Anglo-Saxon and German regulations, and analysing the provisions of the Hungarian Higher Education Act.
