Some Questions of Jurisdiction in Private International Law

Abstract

The occasion of this essay is the establishment of the Codification Committee on Private International Law in 2015, aiming at the replacement of the slightly anachronistic Legislative Decree No. 13 of 1979 by a new Code on Private International Law. One of the most important legal instruments of private international law is the regulation of jurisdiction. In order to find the correct technique of regulating this area, it is expedient to review European acts and any other legislation, which have recently been introduced in the area of jurisdiction. It is also necessary to pay attention to the rules of EU law affecting this area. The essay focuses on the public lawrelated topics of the possible legislation. Therefore, apart from the presentation of the correct legislative method, the essay intends to show the issues of the immunity of state and the proposed institutional model.
