Abstract

The analysis of Hungary’s defense system from the aspect of the migration crisis.

The study introduces Hungary in the aspect of special legal situations. The escalation of the migration crisis means an entirely new challenge. Presently five qualified periods exist from which four have already been a part of the constitution while the fifth was introduced in 2015. The constitution defines the following cases of special law: state of extraordinary measure, state of necessity, preventive defensive situation, unexpected attack and state of emergency. In order to handle migration crisis related threats declaring ‘preventive defensive situation’ proved to be the most efficient solution. In September 2015 a new category ‘crisis of mass migration’ was introduced. Hungary’s National Security Strategy states that in the case of new security related challenges comprehensive and coordinated political, economical and – if it’s necessary – military measures have to be taken. This study examines the additional authority of the army in the case of mass migration in details.
