Judicial Approach of the New Administrative Penal Code

Abstract

In Hungary the new Act of Offences entered into force on 15th April 2012. During the practical application of the law several problems occured, which have not been fully eliminated in spite of the numerous modifications of the Act. The aim of this paper is to interduce the most frequent questions arising in the jurisdiction, to focus on the inconsistency between the Act of Offences and the Criminal Code and on concerns arising during the procedures against the recidivists, or on the problems experienced in arraignments.
