The Law of Order or Chaos?
Abstract
One of the most important recent constitutional changes was the realignment of the subjective and objective sanctions with an obvious shift towards objective sanctions. This process was clearly speeded up by the Act on Offences adopted in 2012. This legislation, on the one hand, significantly decreased the number of (petty) offences. On the other hand, it repelled the so far so typical Janus-faced nature of offences, as the legal institution shifted it towards criminal law. The publication shows what kind of discrepancies exist in this area after the legislation.
