Challenges Connected to the Reform of the Structure of the Administrative Courts

Abstract

Within the framework of the reform of the administrative jurisdiction, after creating the Code of Administrative Litigation, the new focus is the renewal of the structure of the administrative court system. In this essay we draw conclusions for the future on the basis of the experiences of the past and the present. We underline that the reformed administrative jurisdiction can fulfil its social function only if it is effective with a service provider nature, understands the administrative enforcement, considers the ruling in panel fundamental, aspires for consistency in the enforcement, is able to react to the social changes sensitively and fast but non-politicized, independent and stabile.
