The Insurance Contracts’ Certain Current Matters
Abstract
The insurance agreement is a special type of agreement form. The author presents the historical reasons for the development of the insurance agreement drawing the attention to its key elements: the element of risk and the concept of risk pool. The author describes risk pool as a legal concept writing about its origin and its present and future legal regulation. The author also examines those insurance services in detail which are not regulated by the present Hungarian civil law codex in spite of being real insurance practices. The author therefore presents those types of insurance forms where the legislative procedure is still in process. The study also examines the legal concept of group insurances describing the legal characteristics of group insurances and the rights and duties of the contracting parties. At last the study summarizes the current legislation of health insurance, presents its main rules and points out the main differences between health insurance and other insurance types also drawing the attention to the self-sufficient nature of health insurance.
