The Case-Law of the European Court of Human Rights

Abstract

In this part of the paper I present some relevant cases of the European Court of Human Rights in connection with mentally ill prisoners. In its judgments the Court found that there had been a violation of Article 3 of the Convention. In most cases the lack of adequate medical treatment amounted to inhuman and degrading treatment. Finally, the paper summarizes the mentally ill prisoners’ special needs based on the Court’s case-law.
