Lawyers in the Retrial Procedure (questionnaire survey)

Abstract

I conducted a questionnaire survey among lawyers in connection with their participation in retrial as extraordinary legal remedy asking them how they perceive the regulations and their roles. I summarised the replies received to the 23 questions of the survey. It can be concluded that lawyers are less involved in retrials, since they are aware of the exhaustive reasons for retrials. However, lawyers are those professionals who are capable of judging the “error” of the legally binding decision and submit evidence, which is really new in the case, so the lawyer’s role would be essential after the final decision of the criminal matters.
