Natural Law and Criminal Law: The Work of Gustav Radbruch

Abstract

All of the outstanding representatives of the Enlightenment set a target to create human freedom, dignity, equality, justice, legality and legal certainty, even though these are often in conflict with one another. One way of resolving the conflict is Radbruch’s formula, which represents a middle ground between legal positivism and natural law.
